And. for the further encouraging the ufing of Broad Wheels, Be it further enafied by the of the Wheels fix inches Authority aforefaid. That from and after the firft Day of September one thoufand feven hun- broad, drawn by thice ^j,.gj ^,^j fifty-nine, all Waggons, Wains and Carts, whereof the Fellies of the Wheels are of the Breadth or Gage of fix Inches from Side to Side, at the leaft, drawn by three Horfes, Mares, or Geldings, fhall only be liable and fubjedl to Payment of fuch Toll or Duty as ia. at prcfent impofcd, by the Ads of Parliament already made, upon Waggons, Wains and Carts, drawn by two Horfes. VIII. Provided always, and be it further enacted by the Authority aforefaid, That nothing in this A£l contained (hall be deemed or conllrued to extend to any Chaifc Marine, Coach, Chariot, Lan- dau, Berlin, Chaife, Chair, or Calafh. IX. And, for the better difcavering and detecting the Offenders againft this A<£t; It Is hereby further enabled, That it i"hall and may be lawful to and for the Trultees appointed, or to be ap- pointed, by any A£l: or Ads of Parliament made, or to be made, for the ivpairijig or amending any Higway or Higways withithin that Part of G)e(U Britain called Scoth^nd^ or any five or more of them, and they are hereby authorized and required, by Writing.under their Hands, to order the Fellies of the Wheels of all Waggons, Wains, Carts, and other Carriages, which are, or ought to be, of the Breadth or Gage herein before diredled and prefcribed, to be meafured and gaged at any Turnpike or Toll-gate erecled, or to be erected, upon any Part of the Highv/ay cr Road, in or up- on which I'uch Waggon, Wain, Cart, or Carriage refpe£tivcly, fliall travel, pafs, or be drawn. X. Provided always. That in cafe it fiiall appear to the Satisfaction of the Perfon or Perfons ap- reJuctJ, by. weatLig, not pointed tj meafure aiul gage the faid Wheels, that the Fellies of the Wheels of any Waggon or l^f/,Vl!?n'^v' ^"'^' '^* Wliecl Carriage, travelling or paiTing upon any fuch Turnpike Road, were originally, and when firft nrade, of the Breadth of nine or fix Inches refpeiitively, and, by long Ufagc and Wearing, fliall have been reduced to, and become of, lefs Breadth or Gage; then, and in fuch Cafe, it fhall and may be lawful for fuch Waggon or Wheel Carriage to travel, oafs, or be diawn upon any fuch Turnpike P.oad, fo as the Fellies of all the Wheels thereof refpeitively be not diminiflacd more than one Inch of the full Breadth required by this AiSt. XI. And it is hereby further enadted and declared. That if any Perfon or Perfons fhall hinder, or attempt to prevent or ob{tru6t, the meafuring or gaging the Fellies of fuch Weels, or fhall ufe any Violence to any Perfon or Perfons employed or concerned in fuch meafuring or gaging; each andi every Perfon fo oftending, and being convicted thereof before the faid Trultees, or any five or more of them, upon the Oath of one or more credible Witnefs or Witnefles, which Oath the fiid Tru- ftees or any five or more of them, are hereby impoweied to adminifter, (hall forfeit and pay five Pounds Sterling; one Half to the Informer, and the other Half to be applied to repairing fuch Part or Parts of the faid Road, as the faid Truftees, or any five or more of them, fhall appoint. XII. And be it further enaded by the Authority aforefaid. That all Totls^ Duties, Penalties^ and Forfeitures, by this A£t impofed if not otherwife direded to be levied by this Act, fliall be le- vied by Diftrcfs of the Offenders Goods and Chattels, by Warrant under the FJands ajid Seals of any two or more Juftices of the Peace for the County, City, or Place, where the OtFcnce fhall be committed ; and the Perfons diftraining for fuch Penalties are hereby authorized and impowered to fell the Goods or Chattels fo diitrained, and return the overplus Money, if any there be, upon De- mand, to the Owners of fuch Goods and Chatties, .after fuch Tolls, Duties, Penalties or Forfeitures, with the reafonable Charges of fuch Diftrefs, fhall be dedudted and paid. XIII. And be it further enacted by the Authority aforefaid. That if any Perfon or Perfons fhall think him or themfelves aggrieved by any Order or other Proceedings of the faid Truftees or Juftices, it fhall and may be lawful for him or them to appeal to the Juftices of the Peace for the County or Place where the Caufc of Appeal fhall arifc, in .their General Quartcr-SeHions aflembled, who are hereby authorized and impowered to hear and determine the Matter in Difpute, and whofe Or- der therein fhall be final and conclufivc.
