fore enacted by the King's moft Excellent A4ajefty, by and with the Advice and Confent of the Lords Spi- ritual and Temporal, and Commons, in this prefent Parliament aflemblcd, and by the Authority of the fame, That no Perfon or Perfons whatfoever, at any Time or Times during the Continuance of the prc- f;rnt War with France, (hall, direftly or indirectly, export, tranfport, carry, convey or caufe or procure to be exported, tranfported, carried or conveyed out of or from any of the BritiJ}) Colonies or Plantations in America^ or load or lay on board, or caufe or procure to be laden or laid on board, any Ship or other VeiTel or Boat, in order to be exported or carried out of the faid Colonies or Plantations, any Sort of Corn, Grain, Meal, Malt, Flour, Bread, Bifcuit, Starch, Beef, Pork, Bacon or other Sort of Viflual, whether the faid Commodities fhall or Ihall not be the Produce or A4anufaclure of, or made in the re- fpeclive Colonies or Plantations from whence the fame fliall be defigned to be exported, under the Penal- ties and Forfeitures herein after mentioned; that is to fay. That all the faid Commodities that fhall be fo exported, {hipped or laid on board, or loaded to be exported, fhipped or carried out contrary to this AcSt, Ihall be forfeited, and that every Offender or Offenders therein fliall forfeit the Sum of twenty Shillings of lawful Money oi Great Britain, for every Bufhel of Corn, Grain, Meal, Malt or Ftour, and twelve Pence of the like Money, for every Pound Weight of Bread, Bifcuit, Starch, Beef, Pork, Bacon or other Victual, and fo in Proportion for any greater or lefs Quantity, which {hall be fo exported, {hipped or put on board to be exported, and alfo the Ship, Boat or Veffel, upon which any of the faid Commodities fhall be exported, fhipped or laden to be exported, and all her Guns, Tackle, Apparel and Furniture, fhall be forfeited ; and one Moiety of all fuch Penalties and Forfeitures fhall be to the King's Majefty, his Heirs and Succeffors, and the other Moiety to him or them that will fue for the fame; which faid Penalties and Forfeitures fhall be recovered in the High Court of Admiralty, or any other chief Court of Civil or Criminal Jurifdidioji, in fuch refpeftive Colonics or Plantations; and that the Mafter or Ma- riners of any iuch Ship, Boat or Veflel, wherein any fuch Offence fhall be committed, knowing fuch Offence, and wittingly and willingly aiding and aflifting thereunto, and being thereof duly convicted in any fuch Courts as aforefaid, fhall be imprifoned for the Space of three Months without Bail or Mainprize. n. And be it further enabled by the Authority aforefaid. That it fliall and may be lawful to and for any Perfon or Perfons, being an Officer or Officers of the Cuftoms, or being lawfully authorized in this Behalf by the Lord High Treafurer oi Great Britain, or the CommilTioners of the Treafury for the Time being, or any three or more of them, to take or feize all fuch of the faid Commodities not allowed to be exported by this Ait, or by his Majefty's Royal Proclamation, or fuch Order of Council in purfuance of this A6t, as he or they fhall happen to find, know or difcover, to be laid on board any Ship or other Veffel or Boat at Sea, or in any Port, or in any navigable River or Water, to the Intent or Purpofe to be exported, tranfported or conveyed out of any of the faid Colonies or Plantations, coiitrary to the true Intent of this A£t; and alfo the Ship, Veffel or Boat in which the fame fhall be found, and to bring the faid Goods to the King's Warehoufe or Warehoufes, belonging to the Cuftom-houfe next to the Place where fuch Seizures fhall be made, or to fome other fafe Place (where there are no fuch Warehoufes) in order to be proceeded againft according to Law, and in cafe of Recovery, to be divided according to the Directions of this A(5t. III. Provided always, and be it further enaifted by the Authority aforefaid. That this A£t, or any thing Tifions for Ships herein contained, fhall not extend to prohibit the Exportation or carrying out of fuch or fo much of the on their Voyage i ^^j^j Commodities as fliall be neceffary to be carried in any Ship or Ships, or other VeiTd or Veffels in andforthc their rcfpcctive Voyages, for the Suftenance, Diet and Support of the Commanders, Mafters, Adarineis, King 5 Ships; Paffengers or Others, in the fame Ships or Veffels only, or for the vicftualling or providing any of his Forces, Forts, or jviajelt'y's Ships of War, or other Ships or Veffels in his Majefty's Service, or for his Majefty's Forces, cfpte'd""'"' Forts or Garrifons ; any thing nerein contained to the contrary notwithftanding. The faid Com- ^^ • Provided alfo, and be it further enabled by the Authority aforefaid. That this Adt, or any Thing niodit;es may be herein Contained, fhall not extend to prohibit the Exportation of any of the faid Commodities from tlie carried from the faid Colonies or Plantations to Great Britain or Ireland^ or from any of the faid Colonics or Plantations, f.u Colonies or jq g^y other of the faid Colonies or Plantations, or from any Port or Place in any one of the faid Colo- "*' " nies or Plantations, to any other Port or Place in fuch Colony or Plantation rcfpeiStively ; fo as the Ex- porter do before the fhipping or laying on board the fame, declare the Kingdom, I (land. Planta- tion or Colony, and the Port or Place for which the faid Commodities are refpeCtively defigned, and taking our a ^^■^^ ^^^jj. ^ (Jocquet or Cocqucts, exprefling the Particulars of fuch Conimodilies, and do likcwil'c become ocquet or t e ^^^jj^^j ^jj^ two Sureties of known Refidence in the faid Colonies or Plantations, and of Ability to an- fwcr the Penalty mentioned in the Bonds, in treble the Value of fuch Commodities, to the Chief Officer or Officers of his Majefty's Cuftoms, or the Naval Officer, or fome other Principal Officer belonging to the Port or Place where the fame fhall be fhipped or put on board, or to fuch Perfon or Perfons as fliall be appointed for that Purpofe, by the Lord High Treafurer oi Great Britain, or the Commiffioners of the Trtafury for the l^imc being, or any three or more of thcni (who are hereby impowcred to take fuch Se- curity in his Majefty's Name, and to his Majefty's Ufc) that fuch Comnioditics fhall not be landed or fold in any Parts whatfoever, other than the Kingdom, Ulaiid, Plantation, Colony, Port or Place re- fpctftively, for which the fame fhall be fo declared, and that a Certificate under the Hand and Seal, or H'.mds and Seals of the CoUeitor, Comptroller, or other Chief Officer of the CuPtoms, or if no fuch, of the Naval Oificcr or fome other Principal Officer of the Port or Place where the fame fhall be landed, or fuch Pcrlon or Perfons as fhall be appointed for that Purpofe by tiie Lord High Treafurer of Great Brituiuy or Uic Coiunjiffioufis of the Treafury for the Time bcijig, or any three or more of them, fhall within and lodge the fame in the King's WarC' boufes.
