80 LAWS or THE STANNARIES exhibit an information, or commence an ac- tion against the person or persons so ofFend- Penaideioncar. jnor ; and if it shall bc found by confession utaittoddhuiif; of the party SO oiiendmg, nil dicit, or by verdict, that the tin was so carried and con- veyed as aforesaid, with an intent to defraud the King, or Lord Duke of Cornwall of his said duty, that such tin shall be condemned as forfeited, one moiety thereof to the use of the King, or Lord Duke of Cornwall, and the other moiety to the person or persons ©n carrying awty SO sciziug the samc ; and in case any person uhcoinedtin; ^^ persons shall or do clandestinely carry or convey away uncoined tin, so that the same cannot be seized, it is hereby declared and enacted, that it shall and may be lawful for any officer of the revenue of the King, or Lord Duke of Cornwall, to exhibit an in- formation, or commence an action in the proper stannary-court against the person or persons offending as aforesaid ; and if such person or persons is or are legally convicted . thereof, he or they shall forfeit the whole value of the tin so clandestinely carried or conveyed away, the one moiety thereof to the use of the Iting, or Lord Duke of Cornwall, and the other moiety to the use of the person on buying or sei- or pcrsons suiug for the same. And be it fur- mg uncoin ^j^^^ cuaCtcd, that if any person or persons shall buy or sell tin uncoined, and convey it away, whereby the King, or Lord Duke of Corn- wall shall be defrauded of his duty, such person or persons so offending, being duly convicted thereof by information or action in the stannary-court, in which the said offence shall be committed, shall pay a fine to the King, or Lord Duke of Cornwall, to the full value tin.
