Amendment to
the Constitution of the Kingdom of Thailand,
2528 Buddhist Era

Given on the 8th day of August 2528 BE
Being the 40th year of the present reign

Phra Bat Somdet Phra Paramin Maha Bhumibol Adulyadej gives a great royal command by which He orders with His pleasure that it be announced as follows:

Whereas it is appropriate to amend the Constitution of the Kingdom of Thailand;

Therefore, He orders with His gracious pleasure that the following Amendment to the Constitution of the Kingdom of Thailand be enacted:

Section1.This Constitution is called the "Amendment to the Constitution of the Kingdom of Thailand, 2528 Buddhist Era".

Section2.This Constitution shall come into force from the day following the day of its publication in the Royal Gazette onwards.

Section3.The stipulations of section 90 of the Constitution of the Kingdom of Thailand shall be repealed and replaced by the following stipulations:

"Section90.The number of the Members of the House of Representatives that each province should have shall be calculated in accordance with the standard number of one hundred and fifty thousand people of each province, as evidenced in the civil register announced in the last year before the year of the election, per one Member of the House of Representatives. Any province of which the people are below one hundred and fifty thousand shall be able to elect one Member of the House of Representatives. If the people of any province are above one hundred and fifty thousand, such province shall elect one additional Member of the House of Representatives per every one hundred and fifty thousand people. The residue of one hundred and fifty thousand shall, if reaching or exceeding seventy-five thousand, be counted as one hundred and fifty thousand.

Any province which can only elect not more than three Members of the House of Representatives shall be deemed to be a constituency, and any province which can elect more than three Members of the House of Representatives shall be divided into constituencies, each of which shall be adjusted to have three Members of the House of Representatives.

In the event that the constituencies of a province cannot be divided in such a manner that allows each and every constituency to have three Members of the House of Representatives, the province[1] shall first be divided into constituencies with three Members of the House of Representatives each, but the remaining constituencies must not have less than two Members each.

In the event that any province can have four Members of the House of Representatives, the province[1] shall be divided into two constituencies, each of which shall have two Members of the House of Representatives."

Section4.The following stipulations shall be inserted in the Constitution of the Kingdom of Thailand as section 90bis:

"Section90bis.Any province which is divided into more than one constituency must be divided in such a manner that allows the areas of the constituencies to adjoin each other and adjusts the ratio of the number of the people and the number of the possible Members of the House of Representatives in one constituency to be close to that in another."

Section5.The stipulations of paragraph 1 of section 91 of the Constitution of the Kingdom of Thailand shall be repealed and replaced by the following stipulations:

"Section91.In each constituency, the persons having the right to elect Members of the House of Representatives shall have the right to vote for candidates only in the number equivalent to that of the Members of the House of Representatives that such constituency can have."

Section6.The provisions of this Constitution shall apply to elections as from the first general election which should take place after the day of coming into force of this Constitution.

Before the first general election according to paragraph 1, elections of Members of the House of Representatives to fill vacant positions shall be carried out in accordance with the provisions of the Constitution of the Kingdom of Thailand, 2521 Buddhist Era.
