Section 7. All actions of whatever kind or nature, now pending or hereafter and prior to the organization of the County of Greenlee commenced in the district or probate court of Greenlee County where the subject matter or property in controversy in said action is situated within the limits of the new County of Greenlee, shall be transferred to the proper courts of said County of Greenlee for trial; and in all other actions now pending, or hereafter and prior to the organization of the County of Greenlee commenced, in said respective courts, where both plaintiffs and defendants are residents of said Greenlee County and said action does not relate to real estate in said County of Graham (or when said action cannot properly be tried in the courts where they were instituted,) the same shall be transferred to the proper court respectively of the said County of Greenlee, and it is hereby made the duty of the respective Clerks of the County of Graham, immediately upon the appointment and qualification of the clerks of the district and probate courts of the said County of Greenlee, to transmit to the clerks of the corresponding courts in said County of Greenlee, all papers and files in said action, together with a complete certified copy of all entries relating thereto appearing upon the records of their respective courts, where the title to real estate is not involved, and in all actions pending in said courts in said County of Graham, wherein one of the parties is a resident of said County of Greenlee, both parties consenting thereto by written stipulation filed with the clerks of said respective courts of Graham County, it shall be and is hereby made the duty of the clerks of the respective courts, immediately upon the filing of such stipulations, to transmit to the clerk of the proper court of Greenlee County, all papers and pleadings in said action, together with a complete certified copy of all entries thereto appearing upon the records of their respective courts; Provided, however, that in all civil actions, it shall not be the duty of such
