The title of the pres. peer to the earldom was confirmed by the House of Lords in 1891, in opposition to Lord Fitzhardinge, who claimed by descent from a s. of 5th Baron b. previously to a marriage of that peer with Mary Cole in 1796, though subsequently to an alleged marriage in 1785 which was held not to have been proved (vide Fitzhardinge). The 1st Earl was 9th Baron Berkeley (by writ of summons). The claim to the title having been disallowed in 1811, the pres. peer is the first representative of the title who has taken his seat in the House of Lords for nearly 100 years. Berks Regt. ; sue. her mother 1899 ; is heir general to the earldom of Ormond (Ireland), by direct descent from 1st Earl, Sir Thomas Boleyn, K.G., father of Anne Boleyn, and claims to be co -heiress to the barony of Braose, of Gower (see Dormant title. ). This title had its origin by writ of summons directed to James de Berkeley inl421 ; the 9th Baron was creat. Earl of Berkeley in 1679 ; at the death of the 6th Earl the earldom descended to the heir male (the 7th Earl of Berkeley), while the barony devolved upon the heir general.
