The grandfather of present peer, who succeeded his coasin in the Earldom of Kellie, brought a claim to the Earl- dom of Mar before the House of Lords in 1867 and following years, but no decision was arrived at until 1875, when judgment was given to the effect that the title of 'Mar, conferred by Queen JIary in 1565, was an entirely new creation, which was heritable therefore in the male line only. This decision placed the Earldom of Mar then in existence in the possession of the father of the present jpeev, who had previously borne the title
