' II. And whereas divers Perfons of eminent Loyalty to his Majefty, and of known AfFedion to the Li- turgy of the Church oi England, who by the faid Act were required to fubfcribe the faid Declaration or ' Acknowledgment, at the Time of the paffingof the faid Adl were out of this Realm, in h-eland, or other ' Parts beyond the Seas, upon lawful and juftitiable Occafions, and had no Knowledge or Notice thereof ' until their Return into England, being after the faid Feaft of Saint Bartholomew ; and divers other of the 'faid loyal and well-affeded Perfons, by Reafonof Sicknefs, Imprifonment, Difability of Body, or other- ' wife, could not or did not refort unto their refpedive Archbilhops, Bidiops or Ordinaries, or Vice-Chan- cellors of the refpedive Univeriities, before whom fuch Subfcription was appointed by the faid A6t to be made : All which faid Perfons are by Force of the faid A6t: utterly difabled, and ipfo faifo deprived of ' their refpedive Deanries, Canonries, Prebendaries, Mafterlhips, Fellowlhips, Parfonages, Vicarages, or ' other Ecclefiaftical Benefices or Promotions, by Reafon of fuch their Omillion.' III. For Remedy whereof, and for the Relief of fuch Perfons, be it enacted by the King's mofi: Ex- cellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and the Com- mons, in this prefent Parliament affembled, and by Authority of the fame. That all Deans, Canons, iPrebendaries, Mafters and Fellows of any Colleges, Halls or other Houfes of Learning, and all Parfons, jVicars and other Ecclefiaftical Perfons aforefaid, who at the Time of the palling of the faid K&. being in llreland, or any the Parts beyond the Seas, did not return into this Kingdom before the faid Feaft of Saint 'Bartholomew one thoufand fix hundred fixty and two, or who being in England, by Imprifonment, Sick- hefs, Difability of Body, or otherwife, did not refort unto their reipedtive Archbiihop, Bifliop, Ordinary br Vice-Chancellor of the faid refpedive Univerfities, to fubfcribe the faid Declaration and Acknowledg- Tnent, before the faid Feaft in the Year of our Lord aforefaid, fhall be and are hereby declared to be re- /lored unto and preferved in their refpedive Deanries, Canonries, Prebendaries, Mafterfhips, Fellowlhips^ Parfonages, Vicarages, and other Ecclefiaftical Benefices and Promotions, whereunto no other Perfon or Perfons before the tirft Day of Augq/1 in the Year of our Lord one thoufand fix hundred fixty and three Were or fliall be lawfully inftituted, induced, collated or placed ; and fliall and may hold and enjoy the .tame according to his and their former Right ; the aforefaid Aft, or any Thing therein contained, to the pntrary notwithftanding. IV. Provided, That every fuch Dean, Canon, Prebendary, Mafter and Fellow of any College, Hall br.Houfe of Learning, and all Parfons, Vicars and Curates, and other Ecclefiaftical Perfons, who are or 'fhall by Virtue of this A6f be reftored to or preferved in their faid feveral and refpedive Promotions, fliall ibefore the Feaft of the Nativity of our Lord next enfuing, if he be in England, or if beyond the Seas, jwithin forty Days after his Return into England, fubfcribe the faid Declaration or Acknowledgment be- fore the refpedive Archbifliop, Bifhop or Ordinary of the Diocefe, or Vice-Chancellor aforefaid refpec- jively ; (2) and that every fuch Parfon, Vicar, Curate or Ledurer (hall procure a Certificate under the jHand and Seal of the refpedive Archbiihop, Bifhop or Ordinary of the Diocefe (who are hereby required gnd enjoined upon Demand to make and deliver fuch Certificate) and Ihall publickly and openly read the -ame, together with the Declaration or Acknowledgment aforefaid, upon fome Lord's Day within three IVlonths then next following fuch Subfcription, in his Parifh Church where he is to officiate, in the Pre- fence of the Congregation then affembled, in the Time of Divine Service. V. And be it forther enaded and declared by the Authority aforefaid. That every Subfcription already nade, or hereafter to be made, before any Vicar General or Chancellor to any Archbiihop or Bilhop, or JommifiTary to the ArchbiOiop of Canterbury or any other Bilhop, is and (hall be as eifeitual and bene- icial in Law to all Intents and Purpofes to every Perfon and Perfons which have or (hall make fuch Sub- fcription as aforefaid, as if the fame had been made before the Archbifliop or Bifhop of the Province or Diocefe refpedively ; any Thing in the aforefaid Ad to the contrary notwithftanding. VI. Provided alfo, That every Perfon who (hall have Benefit by this Ad, (hall make fuch Allowance or ferving the Cure fince the tv/enty-fourth of Augujl one thouland fix hundred fixty-two, as ihall be •judged fit by the Ordinary of the Place, and (hall pay and difcharge all Tenths, Penfions and other pharges, wherewith the Benefice to which he is by this Ad reftored, hath been or might be legally charged once the Day aforefaid. j ' VII. And whereas fome Doubt hath arifen, whether Perfons prohibited to preach by the faid Ad are I in the fame Plight as to Punifliment, with Perfons difabled by the faid Ad to preach ;' (2) Be it de- Wed and enaded by the Authority aforefaid.
