The Duty of the Surveyors a/id Supetvifors, "Who may deter- mine Differences between iirft and later Builders, Houfea of the fir(t and kaft £o.'t of Building, Houfes of the fecond Sort of £uUding* Houfes of the third Sort of Building. Houfes of the fourth Sort of Building. rronalty and Citizens of the faid City, the Sum of ten Pounds, to be imployed in and towards the Re-' pairing of the publick. Buildings of the faid City. (3) Provided always, That where any fuch Offence fhall be committed by any Perfon or Perfons of low and mean Condition, whom the faid Jullice or Juftices of the Peace fliall in his Confcience believe to be unable to fatisfy the faid Penalties; That then and in fuch Cafe the faid Juftice or Juftices of the Peace fhall and may, by Order and Warrant under his or their Hands and Seals, caufe fuch Offender to be openly whipped near unto the Place where the Offence fhall be com- mitted, till his Body be bloody ; (4) and that it fhall and may be lawful for the faid Juftice or Juftices of Peace to reward the faid Informer out of the Pecuniary Penalty to be incurred, according to his Difcretion, not exceeding a third Part of the faid Penalty. ' VII. And in regard the Building with Brick is not only more comely and durable, but alfo more fafe ' againft future Perils of Fire;' (z) Be it further enafted by and with the Authority aforefaid. That all the Outfides of all Buildings in and about the faid City be henceforth made of Brick or Stone, or of Brick and Stone together, except Door-cafes and Window-frames, the Breft Summers, and other Parts of the firft Story to the Front, between the Piers, which are to be left to the Difcretion of the Builder, to vife, fubftantial Oaken Timber inftead of Brick or Stone, for Conveniency of Shops; and that the faid Doors, Breft Summers and Window-frames be fufKciently difcharged of the Burthen of the Fabrick by Arch-work' of Brick or Stone, either ftraightor circular, VIII. And be it ena£ted, That the faid Surveyors or Supervifors fo to be appointed as aforefaid, and every of them, within their feveral Precinfts, fhall take care, that in Building of all Houfes within the faid City and Liberties thereof, there be, and it is hereby enaded by the Authority aforefaid, That there fhall be Party- walls and Party-pieis, fet out equally on each Builder's Ground, to be built up by the firft Beginner 1 of fuch Building; and that convenient Toothing be left in the Front-wall by the faid firft Builder, for the' better joining of the next Houfe that fhall be built to the fame: (2) And that no Man be permitted by the faid Surveyors, to build on the faid Party-wall, or on his own contiguous Ground, until he hath fully reimburfed the faid firft Builder the full Moiety of the Charges of the faid Party-wall and Pier, together with Intereft for the fame, after the Rate of fix Pounds per Cent, per Jnnum, for Forbearance thereof, to ■ be accounted from the Beginning of the faid firft Building. (3) And in Cafe any Difference fhall arife be- tween the firft and latter Builders, concerning the true Value of the faid Charge, That then the fame be referred- to the Alderman of that Ward where fuch Buildings fhall be, and to his Deputy, to mediate an Agreement of fuch Difference; and where the faid Alderman and his Deputy, or one of them, fhall be Parties, or where they cannot compofe fuch Difference as aforefaid, that the Matter be referred to the Ex- amination of the Lord Mayor and Court of Aldermen, who fhall hear and finally determine the fame,^ without any Appeal to be had. IX. And be it further enafted. That the faid Houfes of the firft and leaft Sort of Building, fronting By- ftreets or Lanes as aforefaid, fhall be of two Stories high, befides Cellars and Garrets; that the Cellars thereof be fix Foot and a Half high, if the Springs of Water hinder not; that the firft Story be nine Foot high from the Floor to the Cieling, and the fecond Story nine Foot high from the Floor to theCieling; that all Walls in Front and Reer, as high as the firft Story, be of the full Thickncfs of the Length of two Bricks, and thence upwards to the Garrets, of the Thicknefs of one Brick and an Half; and that the Thickncfs of the Garret-walls on the back Part be left to the Difcretion of the Builder, fo that the fame be not lefs than the Length of one Brick ; and alfo that the Thicknefs of the Party-walls between thefe Houfes of this firft and leffer Sort of Buildings, be one Brick and an Half, as high as the faid Garrets ; and that the Thicknefs of the Party-walls in the Garrets be of the Thicknefs of one Brick in Length at the leaft; and that the Scantlings of Timber and Stone to be ufed about the Building thereof, be as in the faid Table are fet down and prefcribed. X. And be It further enafted. That the faid Houfes of the fecond Sort of Building, fronting Streets and Lanes of Note, and the River of Thames, fltall confift of three Stories high, befides Cellars and Garrets, as aforefaid ; that the Cellars thereof be fix Foot and an Half high (if the Springs of Water hinder not;) that the firft Story contain full ten Foot in Height from the Floor to the Cieling; the fecond, full ten Foot; the third, nine Foot: (2) That all the faid Walls in Front and Reer, as high as the firft Story, be of the full Thicknefs of the Length of two Bricks and an Flalf, and from thence upwards to the Garret-floor of the Thicknefs of one Brick and an Half; and that the Thicknefs of the Garret-walls on the back Part be left to the Difcretion of the Builder, fo that the fame be not lefs than the Length of one Brick ; (3) and alfo that the Thicknefs of the Party-walls between every Houfe of this fecond and larger Sort of Building, betwo Bricks Length as high as the firft Story, and thence upwards to the Garrets of the Thicknefs of one Brick and an Half: The Scantlings of Timber and Stone to be as in the faid Table are prefcribed. XI. Alfo that the Houfes of the third Sort of Building, fronting the high and principal Streets, fhall con- fift of four Stories hiah, befides Cellars and Garrets, as aforefaid; that the firft Story contain full ten Foot in Height from the Floor to the Cieling ; the fecond, ten Foot and an Half; the third, nine Foot; the fourth, eight Foot and an Half: (2) That all the faid Walls in Front and Reer, as high as the firft Story, be of the full Thicknefs of the Length of two Bricks and an Half, and from thence upwards to the Gar- ret-floor of the Thicknefs of one Brick and Half; that the Thicknefs of the Garret-walls on the back Part be left to the Difcretion of the Builder, fo as the fame be not lefs than the Length of one Brick; (1,) and alfo that the Thicknefs of the Party-walls between every Houfe of this third and larger Sort of Building, be two Bricks Lengths as high as the firft Story, and thence upwards to the Garrets, of the Thicknefs of one Brick and an Half: The Scantlings of Timber and Stone to be as in the faid Table are prefcribed. XII. And be it ftn-ther enacted.
