An A(5t for veftlng certain Lands, Tenements, and Hereditaments in Truftees, for the better fortifying and lecuring the Harbours and Doclcsat Portfmouth, Chatham and Harwich. 7 Anas, c. i6, ' "ITT H E R E A S in purfuance of an Aft of Parliament pafTed in the feventh Year of her now Ma- VV jefty's Reign, intituled, An ASi for appointing Commijfioners to treat and agree for Juch Lands, Te- nements and Hereditaments., as Jhall he judged proper to be pur chafed for the better fort fying Pai:t[moutiy Chatham and Harwich, her Majefty was pleafed by Letters Patents under the Great Seal of Great Bri- tain, bearing Date at JFefminfter the feventeenth Day oi June in the eighth Year of her Reign, to au- thorize certain Perfons therein mentioned, or any five or more of them, to make Surveys of and parti- cularly defcribe all fuch Lands, Tenements and Hereditaments, as are proper to be purchafed for the Ufes and Purpofes aforefaid, and to execute all Powers, Directions, Claufes, Matters and Things in the faid A£i: contained : And whereas five or more of the faid Commiflioners have made Surveys of, and particularly defcribed by Lines, Stakes, Boundaries and Plans, fuch Lands, Tenements and Heredi- taments, as they judged proper to be purchafed for the Ufes and Purpofes in the faid A£t mentioned, and have likewife treated and agreed with feveral of the Owners and others interefted in the faid Lands, Te- nements and Hereditaments, who were able and willing to treat and agree for the fame: And whereas- feveral Proprietors of Lands, Tenements and Hereditaments, in the refpe£tive Places of Portfmouth^ Chatham and Harwich, which were by five or more of the faid Commiflioners judged proper to be pur- chafed, have infilled upon extravagant Rates, and refufed to agree with the faid Commiflioners, with- out unreafonable Gain to themfelves ; and other Proprietors by Reafon of Nonage, Coverture, or efpe>- cial Limitations in Settlements, were difabled to treat and agree as aforefaid ; for which Reafons five or more of the faid Commiflioners, purfuant to the faid AS, iffued out their Warrants to the Sheriffs of each County, where the faid feveral Lands, Tenements and Hereditaments refpeftively lay, to impa^ nel and return before them, at fuch Times and Places as by fuch Warrants were appointed, a fuflicient Jury, and at fuch Times and Places refpedtively, a fuflicient Jury appeared, who upon their Oaths did enquire into, and prefent the true Value of all fuch Lands, Tenements and Hereditaments, and the E- ftates and Intereflrs therein, as the faid Commiflioners could not agree for as aforefaid ; which feveral Verdifts or Inquifitlons have been returned and certified, with the whole Proceedings thereupon, to her 'Majefty, into the High Court of Chancery, purfuant and according to the faid Aft of Parliament ; and it being highly neceffarily, that all and fmgular the Proprietors, Owners and PoffeflTors fhould be paid their feveral and refpeftive Sums agreed for, and the feveral Sums afTeflTed by the Juries on Oath as aforefaid, and that the feveral Lands, Tenements and Hereditaments fhould, upon Payment of the faid Sums, be vefted in her Majefty, her Heirs and Succeflbrs, to and for the Ufes and Purpofes aforefaid j Be it enafted, i^c. " After 10 April 17 10, the MeflTuages, ^c, fpecified by Inquifitions returned, are fettled in Truftees, for the Ufe of the refpeftive Owners. The Queen may appoint Commiflioners, who may determine all Rights, i^c. The Commiflioners to enter their Decrees in Books, i^c. Which Decrees (hall be cer- tified to the Clerk of the Crown, and be final. The Commiflioners fhall give 30 Days Notice of their Meeting. How the Proprietors {hall be paid for their refpeftive Eftates. No private Buildings to be erefted on any fuch Lands. If any Houfe, ^c. fhall belong to Perfons difabled to receive the Money, the Commiflioners may order it to be paid for their Ufe, and laid out for purchallng other Lands foi the Parties interefted ; and till fuch Purchafe can be had, the Commiflioners to place out the Money at Intereft, to be paid to the refpeftive Parties.
