Duties on Houfes; and to caufe the fame to be raifed, and (for Default of Payment) to be levied by fuch "kc" "'*' "c '° Ways a pd Means a"s the Duties on Houfes are to be railed and levied in fuch Parifhes or Places respectively, 7 '" and to caufe the Money fo raifed or levied, to be paid to the Receiver General of the faid Duties, or into the Exchequer, for the refpecfive Ufes and Purpofes whereunto fuch Arrears (if they had been duly paid by the faid Collectors) are appropriated and appoinced by the feveral Acts of Parliament in that Behalf; any Law or Statute whatfoever to the-contrary notwithstanding. ' LXII. And whereas divers Ships and VefTels of the Burthen of fifty Tons or under, laden with Tobac- ' co, Brandy, Spirits and other cuftomable or prohibited Goods, pretending to be bound for foreign Parts,
- do frequently lie hovering on the Coaft of Ireland with Intention to run the fame privately on ihore, as
' Opportunity offers, to the great Diminution of his Majefty's Revenue and Ruin of fair Traders; and Shipsof S oTons « g n jp S or VefTels of the Burthen of fifty Tons or under do frequently lie hovering on that Coaft to take in cSlto ' Wool not lawfully licenfed to be brought to England, and other Staple Commodities of Ireland prohibited within 2 Le.igues ' to be exported :' For the better preventing whereof, Be it declared and enacted by the Authority aforefaid, of the Shore, That from and after the firft Day of Augujl one thoufand feven hundred and twenty, where any Ship or officers may en- Veffel of the Burthen of fifty Tons or under, laden with cuftomable or prohibited Goods, (hall be found at tak' U ^ hSh>P t C f Anchor or hovering on the Coaft of Ireland within two "leagues of the Shore, and not proceeding on her the La"din g Un ana Voyage, Wind and Weather permitting, it fhall and may be lawful to and for any Officer or Officers of his take Security of Majefty's Cuftoms of that Kingdom to go on board every fuch Ship or VefTel, and take an Account of the the Matters in Lading, and to demand and take Security from the Matter or other Perfon having or taking the Charge or treble the Vaiue Command of fuch Ship or VefTel in that Voyage, by his own Bond by him to be entred into unto his Ma- bo f ard e fo°°ro-° n J eft y' his Heirs and Suc ceffors, in fuch Sum or Sums of Money as lhall be treble the Value of fuch Goods ceedi ng regularly tnen °n board, with Condition that fuch Ship or VefTel (as foon as Wind and Weather and the State and on thetr Voyage. Condition of fuch Ship or VefTel doth permit) fhall and will proceed regularly on fuch Voyage, and fhall •' Not land, * land fuch Goods (except Wool lawfully licenfed as aforefaid) in and at fome foreign Port or Ports; m tlle ^ R r^ Pd "' and ^ ^ uc ^ Matter or other Perfon having or taking the Charge or Command of fuch Ship or VefTel fhall, i^Geo^ c 22 u P on f" uc h Demand, refufe to enter into fuch Bond, or having entred into fuch Bond fhall not depart or pro- Mafters refilling' cee d regularly on fuch Voyage (as foon as Wind and Weather and the State and Condition of fuch Ship or Bonds or not VefTel fhall permit) unlefs otherwife fuffered to make a longer Stay by the Collector (or other principal departing in 20 Officer in his Abfence) of fuch Port where fuch Ship or Veffel fhall be, not exceeding twenty Days; then roa yS fecure C alT and in e ' tner °^ the ^ Cafes, all the Goods fo on board fuch Ship or VefTel fliall and may, by any Of- theCood^&c. fi cer or Officers of the Cuftoms, by Direction of the Collector or other principal Officer as aforefaid, be taken out of and from fuch Ship or VefTel, and forthwith brought on fhore and fecured; and in cafe the' faid Goods are cuftomable, the Cuftoms and other Duties fhall be paid for the fame; and as concerning' Wool or any prohibited Goods, or other Goods liable to Forfeiture, which may be found on board fuch Ships or VefTels at the Time of their unlading as aforefaid, the fame are hereby declared to be fubject to Forfeiture, and the Officers of the Cuftoms fhall and may profecute the fame, as alfo the Ship or Veffel, in cafe fhe lhall be liable to Condemnation. On landing the LXIII. Provided always, That after fuch Goods are fo taken out of fuch Ship or VefTel, and brought on Goods, Bond fhore, and fecured by fuch Officer or Officers, fuch Bonds fo to be given as aforefaid fliall be void, and de- : . livered up without any Fee or Reward for taking or delivering up the fame; and fuch Bond not being other- w°" d difcha°r ' ed '" w '^ e u, '" cnar g ec ' fhall, on a proper Certificate returned under the Common Seal of the Chief Magistrate in to be vacatedVn an y P' ace or Places beyond the Seas, or under the Hands and Seals of two known BritiJJj or Irijh Merchants Certificate. upon the Place, that fuch Goods were there landed, or upon Proof by credible Perfons, that fuch Goods, were taken by Enemies, or perifhed in the Seas, (the Examination and Proof thereof being left to the Judgment of the Commiffioners of the Cuftoms in Ireland) fliall be vacated and difcharged. Commifiioners LXIV. And it is hereby enacted by the Authority aforefaid, That the Commiffioners or Sub-Commif- of Excife in Ire- fioners of Excife reflectively, in their refpective Limits and Diftricts in Ireland, or the major Part of them, land to deter- are hereby authorized and required to hear and determine all Offences aga'inft any Claufe or Article con-, ences relatin to ta ' nec ' ' n tms or an Y other Act of Parliament now in Force in Ireland, made for preventing the unlawful V/ooll " S Exportation of Wool, Wool-Fells, Shortlings, Mortlings, Wool-Flocks, Wprfted, Bay or Woollen Yarn, Cloth, Serge, Kerfeys, Bays, Sayes, Frizes, Druggets, Cloth-Serges, Shalloons or any other Drapery Stuffs or Woollen Manufactures, made or mixed with Wool of Wool-Flocks, and manufactured in Ire- land; which Commiffioners or Sub-Commiffioners fhall and may proceed in a fummary Way, and give Judgment or Sentence, and levy the Fines, Penalties and Forfeitures thereupon, in fuch or the like Man- ner as they are enabled to proceed, give Judgment, and levy the Fines, Penalties and Forfeitures, in Cafes of Excife in Ireland, by any Act or Acts of Parliament now in Force in that Kingdom None may claim LXV. And be it further enacted. That no Perfon or Perfons fhall be admitted to claim Property in any Sjjto, 6 "? " aBy Seizure that fhall be made upon any Claufe or Claufes in any Act' of Parliament for preventing the unlaw-' land till they ' ful Exportation of Wool from Ireland, till he or they fhall firft have given fufficient Security to the faid have given Se- Commiffioners or Sub-Commiffioners of the Diftrict where fuch Seizure fliall be made, to anfwer the Pe- turity, &c. nalties attending the Forfeiture thereof, if fuch Seizure fhall be adjudged to be good in Law. LXVI. And it is hereby further enacted by the Authority aforefaid, That if any Perfon or Perfons fhall be fued, molefted or profecuted for any Thing done by Virtue or in Purfuance of this Act, or any of the Claufes therein contained, fuch Perfon and Perfons fliall and may plead the General IfTue, and give this Act : General Iffue. and the Special Matter in Evidence for his, her or their Defence; and if afterwards a Verdict fhall pafs for the Defendant or Defendants, or the Plaintiff or Plaintiffs fhall difecntihue his or their Action, or be non- fuited, or Judgment fhall be given againfthirn or t'rhrn upon Demurrer, or otherwife, then fuch Defendant OX Defendants lhall have full Cofts to him or them awarded againft fuch Plaintiff or Phintiffs. 3 CAP. ,
