I. fiat. «. 19. iGeo. 1. flat. c. 21. 1 Geo. 3. fiat. t.SJ, AY it pleafe your moil Excellent Majefty ; Whereas in and by an Act of Parliament, made and palled in the firft Year of your Majefty's Reign, intituled, An A Si for raifing nine hundred and ten thcufand Pounds for publick Services, by Sale of Annuities, after the Rate of five Pounds per Centum per Annum, redee?nable by Parliament, and to authorize a Treaty concerning private Rights claimed by the Proprietors of the -Houfes in Scotland, a certain yearly Sum of forty-five thoufand five hundred Pounds was eftablifhed to be a diftinft and feparate yearly Fund, for anfwering and paying certain An- nuities, after the Rate of five Pounds per Centum per Annum, which were then to be purchafed upon the fame Aft, until the Redemption thereof by Parliament; and the faid yearly Fund was thereby directed to be iffued at the Exchequer, to the firft and chief Cafhier of the Governor and Company of the Bank of England for the Time being, by way of Impreft, and upon Account, for Payment of the faid An- nuities, which were to be purchafed upon that Aft ; and it was thereby enacted, That the Monies which {hould be contributed on the fame Aft, for or towards the Sum of nine hundred and ten thou- fand Pounds therein mentioned, fhould be deemed to be a Capital or Joint Stock, on which fuch An- nuities fhould be attending ; and the fame Joint Stock, and the proportional Annuities attending the fame, were thereby made transferrable and devifable in the Manner thereby prefcribed ; and in the faid Aft is contained a Provifo, That, at any Time upon one Year's Notice, and Repayment by Parlia- ment of the faid Sum of nine hundred and ten thoufand Pounds, or fo much thereof as fhall be advanced upon the faid Aft, unto the refpeftive Contributors of the fame, or to fuch Perfon or Perfons as by, from or under them, fhould then be intitled to the faid Annuities, after the Rate of five Pounds per Cen- tum per Annum, in refpeft of the Money fo advanced, according to fuch Interefts as they refpeftively fhould then have in the fame Annuities ; and alfo upon full Payment and Satisfaction of all Arrears of the faid Annuities, after the Rate of five Pounds per Centum per Annum, (if any fuch (hould be then due) then, and not till then, the faid Annuities, after the Rate of five Pounds per Centum per Annum y created by that Aft, fhould ceafe and determine. And whereas the Contributions on the faid Aft did amount to the faid full Sum of nine hundred and ten thoufand Pounds, and the Annuities, which be- came payable in refpeft of the fame, did amount to the yearly Sum of forty-five thoufand five hundred Pounds : And whereas fince the making of the faid Aft, as much of the faid Capital Stock as amounted to feven hundred fix thoufand one hundred feventy-five Pounds and fifteen Shillings, and as many of the faid Annuities attending the fame, as amounted to thirty-five thoufand three hundred and eight Pounds fifteen Shillings and nine Pence per Annum, have been fubfcribed into the Capital Stock and yearly Fund of the South-Sea Company, and as much of the faid Capital Stock created by the Aft, in Part before recited, as amounts to two hundred three thoufand eight hundred twenty-four Pounds and five Shillings, and as many of the faid Annuities as amount to ten thoufand one hundred ninety-one Pounds four Shillings and three Pence per Annum, in refpeft thereof, do ftill remain transferrable at the Eank, or devifeable as aforefaid, and are payable by the faid Cafhier of the Governor and Company of the Bank of England for the Time being: And whereas in and by certain Claufes contained in ano- ther Aft of Parliament, made and pafied in the faid firft Year of your Majefty's Reign, intituled, An Acl for enlarging the Capital Stock and yearly Fund of the South-Sea Company, and for fupplying thereby eight hundred twenty-two thoufand thirty-two Pounds four Shillings and eight Pence, to publick UJes; and for raifing one hundred fixty-nine thoufand Pounds for the like Ufes, by Sale of Annuities upon divers Encouragements therein mentioned; and for appropriating fever al Supplies granted to his Majefty, for Encouragement of fuch Perfons and Corporations as would advance, for the Service of the Publick, any Sum or Sums of Mo- ney, not exceeding the further Sum of one hundred fixty-nine thoufand Pounds, a certain yearly Sum of eight thoufand four hundred and fifty Pounds was eftablifhed to be a diftinft or feparate Fund, for anfwtring and paying Annuities after the Rate of five Pounds per Centum per Annum, which were there- by to be purchafed, until the Redemption thereof by Parliament; and the faid yearly Fund or Sum of eight thoufand four hundred and fifty Pounds per Annum, was thereby direfted to be iffued at the Ex- chequer, to the firft and chief Cafhier of the Governor and Company of the Bank of England for the Time being, by way of Impreft, and upon Account, for Payment of the faid Annuities not exceeding eight thoufand four hundred and fifty Pounds per Annum ; and it was thereby enafted, That the Monies which fhould be fo contributed or advanced for or towards the faid Sum, not exceeding one hundred fixty-nine thoufand Pounds, fhould be a Capital or Joint Stock, on which the Annuities laft mentioned fhould be attending; and the fame Joint Stock, and the proportional Annuities attending the fame, were thereby made transferrable and devifable in the Manner thereby prefcribed ; and in. the Aft laft mentioned there is contained a Provifo, That at any Time, upon one Year's Notice and Repayment by ' Par-
