D. 1729. feveral Sums of feventeen thoufand five hundred Pounds, and five thoufand Pounds, in Manner aforefaid, -and according to the true Meaning of this Act, that then they the faid Edward Bertie, Samuel Horfey, Henry Smith and Alexius Clayton, or the Survivors or Survivor of them, or the Heirs, Executors or Admi- niftrators of fuch Survivor, {hall not make fuch Surrender, Alignment or Conveyance of the faid feven eighth Parts or Shares of the faid Provinces or Territories, and of the faid Arrears or either of them, to his Majefty, his Heirs or Succeflbrs, as hereby is directed ; but fhall, from and after the faid twenty-ninth Day of September one thoufand feven hundred and twenty- nine, ftarid, and be feized and pofFefled of all and lingular the PremifFes hereby in them veiled, to the only proper Ufe and Behoof of them the faid Henry Duke of Beaufort, William Lord Graven, fames Bertie, Dodington Greville, Henry Bertie, Mary Dan/on, Elijabetb Moor, the prefent Sir John Colleton, John Cotton and Jofeph Blake, and every of them, and of their and every of their Heirs, Executors, Adminiftrators and AiTigns, in fuch Shares and Proportions, and ac- cording to fuch refpective Pvights and Interefts as they feverally had or eould have been intitled to, in and unto the fame Premifles, in cafe this Act had never been made, and to and for no other Ufe, Trull, Intent or Purpofe whatfoever. Sating Claufe. XI. Saving and referring to all and every Perfon and Perfons, Bodies Politick and Corporate, their Heirs, Succeflbrs, Executors, Adminiftrators and Afligns, (other than and except the faid Henry Duke of Beaufort, William Lord Craven, James Bertie, Dodington Greville, Henry Bertie, Mary Dan/on, Elifabeth Moor, Sir John Colleton, Archibald Hutchefon, John Cotton and Jofeph Blake, their refpective Heirs, Executors and Ad- miniftrators, and the Heirs of their refpective Bodies, and all and every Perfon and Perfons claiming or to claim any Eftate or Intereft in the Premifies or any Part thereof, in Remainder or Reverfion, expectant upon, or after the Determination of any Eftate-tail vefted in them the faid Henry Duke of Beaufort, Wil- liam Lord Craven, James Bertie, Dodington Greville, Henry Bertie, Mary Danfon, Elifabeth Moor, Sir John Colleton, Archibald Hutchefon, John Cotton and Jofeph Blake, or any of them, and all and every Perfon and Perfons claiming or to claim any Eftate or Intereft in the Premifles or any Part thereof, by or under the Title of the faid Henry late Duke of Beaufort, deceafed) fuch Satisfaction and Recompence as is herein after mentioned, for all fuch Eftate, Right, Title, Intereft, Property, Claim and Demand whatfoever in, to or out of the Premifles or any Part thereof, as they or any of them now have or might have had or been intitled unto, in cafe this Act had never been made. Perfons having XII. Provided always, and be it further enacted by the Authority aforefaid, That if any Perfon or Per- Kight fuing f ons (other than, and except the Perfons herein before excepted) who now have or fhall have any Eftate, wioiiri feven Right, Title, Intereft, Claim or Demand, either in Law or Equity, of, in, to or out of the Premifles cov« S a™ainfthis hereby vefted as aforefaid, or any Part thereof, fhall, within the Space of feven Years after the fame fhall Majefty. be conveyed unto, and vefted in his Majefty, his Heirs and Succeflbrs as aforefaid, commence and profecute any Action or Suit, either in Law or Equity, by Petition of Right, Englifh Bill or otherwife, againft his Majefty, his Heirs or Succeflbrs, or the proper Officer or Officers on his or their behalf, wherein fuch Per- fons might or ought to have recovered the Premifles hereby vefted as aforefaid, or any Part thereof, or any Eftate, Intereft or Demand, in or out of the fame, the Court wherein fuch Suit or Action fhall be commen- ced or depending fhall and may adjudge or decree, that fuch Perfon or Perfons fhall recover againft his Ma- jefty, his Heirs or Succeflbrs, fuch Sum or Sums of Money, as his or their Eftate, Intereft or Demand, in or out of the Premifles hereby vefted as aforefaid, fhall by the fame Court be valued at and determined to amount unto, in full Satisfaction for fuch Eftate, Intereft and Demand ; in making which Valuation the faid Court fhall eftimate one full eighth Part of the Premifles hereby vefted as aforefaid, to be of the Value of two thoufand five hundred Pounds and no more, and fhall rate and afcertain the Value of fuch Eftate, In- tereft or Demand, in Proportion thereunto. Exception as to XIII. Saving and referving always to the faid John Lord Carteret, his Heirs, Executors, Adminiftrators Lord Carteret, and Affigns, all fuch Eftate, Right, Title, Intereft, Property, Claim and Demand whatfoever, in, unto or out of one eighth Part or Share of the faid Provinces or Territories, with all and fingular the Rights, Members and Appurtenances thereof, and of, in and to one eighth Part or Share of all Arrears of Quit Rents, and other Rents, Sum and Sums of Money, Debts, Duties, Accounts, Reckonings, Claims and Demands, whatfoever, now due and owing to the prefent Lords Proprietors of the faid Provinces and Ter- ritories, and all fuch other Rights, Titles, Privileges and Powers whatfoever, as the faid John Lord Carteret, his Heirs, Executors or Admin iftrators now have, or might have had, or been intitled unto, in cafe this Act, and the Conveyance herein before directed to be made to his Majefty, his Heirs or Succeflbrs, or either of them, had not been, or fhould not be made, and others hold- XIV. Saving alfo to all and every Perfon and Perfons, having or lawfully claiming any OfHce or Offices, jng Office. Place or Places, Imployment or Imployments, by or under any Grant or Grants thereof made before the faid firft Day of January one thoufand feven hundred and twenty-feven, under the common Seal of the faid Lords Proprietors, either in England or in the Provinces aforefaid, all fuch Eftate, Right, Title and Intereft in or to fuch Office and Offices, Place and Places, Imployment and Imployments, as they or any of them now have or might have had or been intitled unto, in cafe this Act had never been made. CAP. XXXV. An Act for the better Prefervation of his Majefty's Woods in America, and for the Encourage- ment of the Importation of naval Stores from thence ; and to encourage the Importation of Mafts, Yards and Bowfprights, from that Part Of Great Britain called Scotland.
