Conlfables ihall in their feveral Turns or Courfes of watching ufe their belt Endeavours to prevent Fires, Murders, Burglaries, Robberies and other Outrages and Dilbrders; and to that end (hall and they are hereby impowered and required to arreft and apprehend all Night-walkers, Malefactors, and fufpecled Perfons, who (hall be found wandering or mifbehaving themfelves, and (hall carry the Perfon or Perfons who (hall be fo apprehended, as foon as conveniently may be, before one or more Juftice or Juftices of the Peace of and for the faid City, to be examined and dealt with according to Law ; and lhall twice or oftner, at convenient Times in every Night, go about their refpective Wards, and take Notice whether all the Watchmen perform their Duties in their feveral Stations, according to fuch Orders and Regula- tions as (hall have been made for that Purpofe by the Lord Mayor, Aldermen and Commons of the faid City in Common Council afiembled, or by the Aldermen, Deputies and Common Council Men of the refpective Wards ; and in cafe any fuch Watchman (hall mifbehave himfelf, or neglect his Duty, the faid Conftables, or one of them, mall, as foon as conveniently may be, give Notice thereof to the Alder- man or his Deputy for the time being of the Ward to which fuch Watchman (hall belong, to the end that the Alderman, Deputy and Common Council Men may be forthwith fummoned, for the Examina- tion and Puni(hment of fuch Offence. VI. And be it further enacted by the Authority aforefaid T That if any of the faid Conftables (hall wil- Penalty of 20s. fully neglect to attend any Night in his or their Turn, to keep Watch and Ward within their refpedive for Default. Wards, or (hall not come to keep Watch or Ward at the refpective Hours appointed by this Act for his and their Attendance thereon, or (hall depart from or leave keeping Watch and Ward during the refpective Hours appointed by this Act for the keeping the fame, or (hall neglect in any Night of his and their watching to go about his arid their refpeclive Wards twice at the lead in each Night of his or their watching for the Purpofe of this AcT:, or (hall otherwife mifbehave himfelf or themfelves againft the Duty prefcribed to them by this AcT:, in each and every of the faid Cafes the Perfon or Perfons fo offending (hall reflectively forfeit the Sum of twenty Shillings for every fuch Offence. VII. And be it further enacted by the Authority aforefaid, That it (hall and may be lawful for the faid Watchmen* Watchmen, or any of them, in the Abfence of the Conftable, and they are alfo hereby authorized and Charge. required in their feveral Stations during the Time of their keeping Watch and Ward as aforefaid, to ap- prehend all Night-walkers, Malefactors, Rogues, Vagabonds, and all diforderly Perfons whom they . ihall find diflurbing the publick Peace, or mall have juft Caufe to fufpect of any evil Defigns, and to de- liver the Perfon or Perfons fo apprehended, as foon as conveniently may be, to the Conftable of the Night, who is hereby required to carry him, her or them as foon as conveniently may be, before one or more Juftice or Juftices of the Peace of the faid City, to be examined and dealt with according to Law. VIII. And be it further enacted, That if any of the Perfons who mail from time to time be directed 10 1. Penalty on and appointed Collectors of the feveral Rates and AfTefiments to be made in purfuance of this Act, fliall Coileftors vefu- neglect or refufe to take upon him or them the faid Office, or duly to execute the fame according to the £ t0 a •" true Intent and Meaning of this Act, he or they (hall respectively forfeit the Sum of ten Pounds, and fliall continue liable to be appointed into the faid Office again the Year following ; and in cafe of his or their Refufal they fhall be again liable to the like Penalties, as often as he or they lhall refufe to take upon , him or them the faid Office; and upon every fuch Refufal of any Perfon or Perfons fo to be appointed Collector or Collectors as aforefaid, to take upon him or them the faid Office, or in cafe of Death after fuch Appointment, it (hall and may be lawful for the Alderman, Deputy and Common Council Men of fuch Ward, or the major Part of them, to direct and appoint any other Perfon or Perfons inhabiting in fuch Ward, to be Collector or Collectors in the Room or Stead of fuch Perfon or Perfons who fliall fo refufe to take upon him or them the faid Office, or fhall die after fuch Appointment; and in cafe fuch Perfon or Perfons fo directed and appointed fhall refufe to take upon him or them the faid Office, he or they fliall be liable^ to the like Penalties as herein before are appointed for any Con- ftable or Bedels, who fliall refufe to i!ake upon him or them the faid Office. IX. And be it further enacted by the Authority aforefaid, That all and every the Collector or Col- Coilefior'sDuty, lectors of the Rates and Affefiinents aforefaid, of every Ward, fliall collect the fame quarterly, and fliall feverally enter in fome Book or Books to be by them reflectively kept for that Purpofe, the feveral Sums which they fhall from time to time receive on account of the faid Rates and AfTelTments, and like- wife the Names of the Perfons from whom, and the particular Times when, they received the fame; which Book and Books they fhall at all convenient Times produce upon demand, and (hew to the Deputy or Deputies of their refpective Wards; and they (hall pay the Money by them reflectively received on account of the faid Rates and Affeflments into the Hands of fuch Deputy, as he or they ihall receive the fame, and in fuch Manner as that fuch Collector lhall never have a Sum exceeding five Pounds fo collected at one Time in his or their Hands by the Space of five Days ; and if any of the faid Collectors fliall neglect to make fuch Entries, or fliall refufe to produce and fhew to the Deputy of their refpective Wards the Book or Books hereby directed to be by them refpectively kept for the Purpofes aforefaid (the fame having been demanded of them) or if any of them fliall keep or retain in his or their Hands more than the faid Sum of five Pounds longer than five Days ; in each and every the faid Cafes the Perfon or Perfons fo offending fhall refpectively forfeit the Sum mi . Penalty on of forty Shillings for every fuch Offence ; and on Payment of every fuch Sum of Money into the Hands Delaulti of fuch Deputy of each Ward, fuch Collector or Collectors fliall take a Receipt for the fame from the faid Deputy, in which Receipt fhall be fpecified and expreffed the Name of fuch Collector or Collectors, the Sum paid, and the Name of the Precinct and Ward wherein the Money hath been collected j
