A;D. 1744. of all fuch Coals as fhould b* fold by Retail, as they from time to time fhould judge reafonable, allow- ing a competent Profit to the faid Retailer, beyond the Price paid by him to the Importer, and the or- dinary Charges thereupon accruing : And whereas many Exactions and Abufes are ufed by Retailers of Sea Coals, brought by Sea into other Rivers, Creeks, Havens, Ports, Cities, Boroughs, Towns, Coun- ties and Places, within the Kingdom of England, Dominion of Wales, and Town of Berwick upon Tweed, befides fuch Counties and Places where fuch Coals brought into the River Thames were and arc fold by Retail : For avoiding of which Exactions and Abufes in fuch other Counties and Places as 3 Juftics to fet the Retail Pries Tempo- ral, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from oTcoVi's'in any an ^ after the twenty-fourth Day of June in the Year of our Lord one thoufand feven hundred and forty- Part 0/ England, four, the Juftices of the Peace of the feveral Counties in the Kingdom of England, Dominion of Wales, &c. and of the Town of Berwick upon Tweed, or any three or more of them, whereof one to be of the Rio- rum, fhall be, and are hereby impowered to fet the Rates and Prices of all fuch Coals, called Sea-Coals, as fhall be brought by Sea into any other Rivers, Creeks, Havens, or Ports, and fold by Retail after landed, in any other Cities, Boroughs, Towns, Counties, and Places within the Kingdom of England, Dominion of Wales, and Town of Berwick upon Tweed, to which the faid recited Aft doth not extend, allowing a com- as they from time to time fhall judge reafonable, allowing a competent Profit to the faid Retailer, beyond pctent Profit to the Price paid by him to the Importer, and the ordinary Charges thereupon accruing; and that if any Ingroffer or Retailer of fuch Coals, fhall refufe to fell as aforefaid, that then the faid Juftices of the Peace refpectively are hereby authorized to appoint and impower fuch Officer or Officers, or other Perfons, as they fhall think fit, to enter into any Wharf, or other Place, where fuch Coals are ftored up; and in cafe of Refufal, taking a Conftable, to force Entrance, and the faid Coals to fell, or caufe to be fold, at fuch Rates as the faid Juftices refpeSively fhall judge reafonable, rendering to fuch Ingroffer or Retailer the Money for which the. faid Coals fhall be fo fold, neceffary Charges being deducted ; and if any Ac- tion fhall be commenced againft the Juftice of Peace, Conftable, or any Officer or Perfon, for any thing to be done in purfuance of this Act, the Defendant in every fuch Action may plead the General IfTue, and give the Special Matter in Evidence; and if the Verdict be found for him, or the Plaintiff become nonfuited, fuch Defendant fhall recover and have his Damages, and Treble Cofts of Suit, for his unjuft Vexation in that Behalf. II. Provided always, That no Perfon having Intereft in any Wharf ufed for the receiving and uttering of Coals, or that doth or fhall trade by himfelf or others, in his own or any other Name, in the Sale of any Coals, or the engroffing the fame, in order to fell the fame, and not for his own private Ufe only, fhall act, or otherwise intermeddle in the fetting the Price of Coals j any thing in this Act to the con- trary in any wife notwithftanding. ' XTTH E RE A S by a Claufe in an Act of Parliament palled in the twelfth Year of the Reign of VV King Charles the Second, intituled, An Ail for the encouraging and increafmg of Shipping and Navigation, It is enacted, That no Goods or Commodities of the Growth, Production, or Manufac- ture of Mufcovy, or of any the Countries^ Dominions, or Territories to the Great Duke or Emperor of Mufcovy or Rujfia belonging; as alio that no Sorts of Mafts, Timber, or Boards, no foreign Salt, Pitch, Tar, Rozin, Himp, or Fkx, Raifins, Figs, Prunes, Olive Oils, no Sort of Corn or Grain, Sugar, Pot-afhes, Wines, Vinegar, or Spirits called Aqua Vites, or Brandy Wine, fhould, from und after the firft Day of April which was in the Year of our Lord one thoufand fix hundred fixty-one, be imported into England, Ireland, Wales, or Town of Berwick upon Tweed, in any Ship or Ships, Vefl'el or Veflels whatfoever, but in fuch as do truly, and without Fraud, belong to the People thereof, or fome of them, as the true Owners and Proprietors thereof, and whereof the Mafter and three Fourths- of the Mariners, at leaff, are Englijh ; and that no Currans, nor Commodities of the Growth, Product, or Manufacture of any of the Countries, Iflands, Dominions, or Territories to the Othoman or Turkijh Empire belonging, fhould, from and after the firft Day of September which was in the Year of our Lord one thoufand fix hundred fixty-one, be imported into any the forementioned Places, in any Ship jar Veflel, but which is of Englijh built, and navigated as aforefaid, and in no other, except only fuch f foreign Ships and Veflels, as are of the Built of that Country or.
