An Aci fir making void the feveral ContraEis for Sale of the EJiate g/" James late Earl_ o/" Derwentwater to William Smith Efquire, and alfo of the Annuity of two hundred Pounds, during the Life of Charles Raddiffe, a;: : :r: Arrears thereof, /« Matthew White Efquire, and the feveral Conveyances made in purfuance of the fame ,) it was, for the Reafons therein contained, enafted, That the feveral Contrafts made, figned or entered into, or pretended to be made, figned or entered into, by the faid Commiffioners and Truftees, or any of them, for the Sale or Conveyance to the faid William Smith, of any Eftate, Right, Title, or Intereft of, in, to or out of the Barony, Manors, Lordfliips, Mefl'uages, Farms, Lands, Tenements, Reftories, Tythes, Hereditaments, and Premiffes, in the faid recited Settlements of the twenty-fourth of March one thou- fand fix hundred and ninety-one, and twenty-fourth of June one thoufand feven hundred and twelve, comprized, or either of them, or of, in, to or out of any Part or Parcel thereof, or any Lands, Tene- ments or Hereditaments whatfoever, contrafted or pretended to be contrafted for by the faid William Smith, for the Sum of one thoufand and fixty Pounds ; and alfo the Contraft or Contrafts, or pretended Contrad or Contrafts, for the Sale, Conveyance or Affignment to the faid Matthew White, of the faid Annuity <jf two hundred Pounds, granted to or charged for the Benefit of the faid Charles Raddiffe, as therein is men- tioned, and of the Arrears of the fame ; and alfo the faid feveral recited Indentures of Bargain and Sate refpeftively, bearing Date the twenty-eighth Day of September in the Year one thoufand feven hundred and twenty-three ; and one other Indenture of Bargain and Sale therein reci:ed, bearing Date the faid twenty-eighth Day of September one thoufand feven hundred and twenty-three, being the Indenture of Bargain and Sale therein recited to have been made to the faid Mattheiv JFhitc, of the faid Annuity or yearly Rent of two hundred Pounds, fo granted to the faid Charles Raddiffe for his Life as aforefaid, to- gether with the Arrears thereof incurred and grown due, from the Time of the Attainder of the faid Crurh Raddiffe, to the Day of the Date of the faid Indenture ; and all and every the Bargains, Sales, Con- veyances, Deeds and Inflruments figned, fealed, made or executed, or pretended fo to be, for the convey- ing, transferring, vefting, paffing and afluring the faid feveral Eftates, Interefts, Annuity, Arrears, and other the Premiiles, or any Part or Parcel thereof, unto the faid IFitUam Smith and Matthew Wd'.c, or either of them, their or either of their Heirs, Executors, Adminiftrators or Affigns, fliould be, and were thereby fet afide and annulled, and were thereby adjudged and declared to be, and to have been abfolutely null and void to all Intents, Conflriiftions and Purpofcs, as if the fame had never been made ; and the At- torney (jeneral of his Majefty, his Heirs and Succeflbrs, by his or their Direftion, v,-as thereby impowcr- ed to apply to the Court of Exchequer for Sale, and the faid Court was thereby impowered to order Sale of the faid Barony, R'lanors, Lands, Hereditaments, and Premilfes (fubjcft to ilich Claims and I)em.ind<, as had been allowed by the faid Commiffioners and Truftees, according to the faid recited Aft of the fourth Year of his faid late Majefty's Reign) for fuch Eftate and Intercft as was vefted in his Majefty, his Heirs and Succeffors, as aforefaid ; and the Purchafe-nioney was to be paid into the Receipt of his Maje- fty's Exchequer, to be applied and difpofid of according to any Aft or Aftj of Parliament then after to be m;ide for that Purpofe ; and it was thereby further enafted, I'hat until fuch Sale fliould be made, as hv the faid Aft is direfted, it fliould be lawful for the Lords Commiffioners of his Majefty's Treafury, or any three or more of them, or the Lord High Trcafurer i"or the Time being, to caufe ro be collefted and le- vied all the Rents, Ifiues and Profits of the faid Barony, R-Tancrs, Lands, Hereditaments and Premirte-S and all Arrearages thereof fince the Death of ihc faid John Raddiffe; and to fue for and recover the fan^c in the Name ot his Majefty, his Heirs and SucceiTors, and to caute all the Monies arifing thereby (thene- ctfiary Charges of levying, collcfting, fuing for and reco'cring the fame, and the incident Charges rda- ting thereunto only excepted) to be brought and paid into the Receipt of the Exchequer, to be appliedand diCpoftd of, according to any Aft or Afts o' Parliament thcieafter to be made for that Purpofe ;
