C. 52. 20s Perfons concerned with them in the faid Contrafts or Purchafes, their refpe£Hve Heirs, Executors, Ad- miniftrators and Afllgns, and all Perfons claiming or to claim any Eftate, Right, Title, Intereil: or De- mand, either in Law or Equity, in, unto, or out of the faid PremiiTes, by, from or under them, of all fuch Right, Title, Eftate, interefl-, Claim or Demand, of, in, unto, or out of the faid Premiffes, as they might ifavc had, or been intitled unto, in cafe that Aft had never been made : And whereas by another Aft of Parliament made in the eighth Year of the Reign of his prefent Majefty, (intituled An AEl for the 8 Cco. 3. c 19, Applicaticn of the Rents and Profts of the Efates foyfelted by the Attainders of James late Earl of Derwent- water and Charles Radcliffe) reciting, amongft other Things, That there then remained in the Pv.eceipt of his Majeily's Exchequer the Sum of feven thoufand one hundred and eighty-two Pounds, thirteen Shil- lings, which had ariferi out of the Rents and Profits of the faid Prem.ilTes {o veftcd in his Adajefty as afore- faid ; and that there were alfo feveral Sums of Money in the Hands of the Colleftors and Receivers, and due and in A, rear from the Tenants and Farmers of the faid Premiffes ; and farther reciting. That the Annuity of Rent Charge, and alfo the feveral Mortgages and Incumbrances of and upon the faid Eftate of the laid late Earl of Derwentivater, or fome Part thereof, therein and herein after particularly mentioned, had been regularly claimed and allowed, according to the Direftion of the faid Aft of the fourth Year of his faid late Majefty's Reign ; and that there was then due, owing, iffuing and payable out of the faid Eftate, or fome Part thereof, to the feveral Perfons therein and herein after-named, the feveral Sums of Money and Annuity therein and herein after-mentioned ; that is to fay, to the Right Ho- nourable Robert fames Lord Petre the Sum of twenty thoufand Pounds Principal Money, with the Intereft: thereof; to Cuthhert Corjlable, alias Tunfall, oi Burton Conflable m Holdernefs, in the County oi Tork, Efquire, upon Mortgage, the Sum of five thoufand nine hundred Pounds, Principal Money, befides In- tereft ; to Mary Chamberlain Spinfter, Edward Hopkins of the City of Coventry Efquire, and Anna Maria his Wife, Richard Luther Efquire, and C/;rtr/o«^ his Wife, upon Mortgage, the Sum of three thoufand Pounds Principal Money, befides Intereft ; to the Lady Catherine RadcUffe, Second Daughter of Francis late Earl of Dcrwentwater, one Annuity or yearly Rent Charge of one hundred Pounds, clear of all _ Taxes, for the Term of her natural Life, with the Arrears thereof; it wasenafted. That the faid Sum of feven thoufand one hundred and eighty-two Pounds thirteen Shillings, fo arifing and produced of the Rents and Profits of the faid Premiffes, and remaining in the Receipt of the Exchequer as aforefaid, fhould be iffued, appropriated and applied, in the firft Place, for the paying and clearing of all Intereit and Arrears of the laid Annuity of one hundred Pounds a Year, and Licumbrances therein and herein be- fore-mentioned, to the twenty-fifth Day oi March one thoufand feven hundred and thirty-iive ; and after Payment thereof, the Surplus and Refidue of the faid Sum of feven thoufand one hundred and eighty-two Pounds thirteen Shillings fliould (except as therein after is excepted) be appropriated and applied, and v/as thereby appropriated and applied, towards the building and finifliing of the Royal Flofpital for Sea- men at Greenwich : And it was thereby further enafted. That all Sums of Money collefted and received by the refpeftive Receivers of the Rents and Profits of the faid Premiffes, fo forfeited and vefi:ed in his Majefty as aforefaid, which were not paid into the Receipt of the Exchequer on or before the twenty- fifth Day of Alarch one thoufand feven hundred and thirty-five, and all Arrears of Rents and Profits of the fame Premiffes, due and owing from, the feveral Farmers, Tenants and Occupiers of any Part or Parts thereof at or on the faid twenty-fifth Day of March one thoufand feven hundred and thirty-five ; and all the Rents, Iffues and Profits of the faid Premiffes, which fhould, from and after the fiiid twenty-fifth Day of March one. thoufand feven hundred and thirty-five, grow, accrue or become due and payable for and during his Majefty's faid Eft-ate and Intereft in the faid Premiffes, fubjeft in the firft Place to the Payment of the faid Annuity of one hundred Pounds a Year, as the fame ftiall grow due, and of all Principal and Intereft due and to grow due upon the feveral Incumbrances therein, and herein before-mentioned, fliould be iffued and applied, and vfert thereby appropriated and applied in the firft Place for and towards the finifliing and completing the Building of the faid Royal Hofpital for Seamen at Greemvich ; and after the Building of the fame Royal Hofpital fliould be completed and finifhed, for and towards the Support of the faid Royal Hofpital for the better Maintenance of the Seamen of the faid Hofpital, worn out and be- come decrepit in the Service of their Country : And it was thereby further enafted and declared. That the faid Premiffes fo forfeited and vefted in his Majefty as aforefaid, fliould not be fold (except as in the faid Aft is excepted) but fhould remain and continue vefted in his Majefty, his Heirs and Succeffors (fub- jeft to, and charged and chargeable with, the faid Annuity of one hundred Pounds, and Incumbrances aforefaid, and the Payment thereof, in the firft: Place) for fuch Eftate and Intereft as aforefaid, for the Purpofes of the faid laft-recited Aft : And his Majefty, his Heirs and Succeffors were, by the faid laft- recited Aft, impowered to authorize the ComniiiTioners or Governors of the faid Royal Hofpital for the time being, or any feven or more of them, to appoint Stewards, R.eceivers or Bailiffs of the faid Premiffes, fo forfeited and vefted in his Majefty as aforefaid, for and during the faid Eftate and Intereft of his Ma- jefty, his Heirs and Succeffors, in the lame Premiffes; and to inveft them with full Power to receive the Rents, Iffues and Profits thereof ; and to give Receipts, Difcharges and Acquittances for the fame ; and to hold Courts, and to do and perform all Acts, Matters and Things, neceffary for the managing the faid Premifies, ufually done and performed by Stewards, Receivers and Bailiffs : And his Majefty, his ' I Heirs and Succeffors, were, by the faid laft-recited Act alfo impowered, during the Continuance of the faid Eftate and Intereft of his Majefty, his Heirs and Succeffors, in the faid Premiffes, to authorize the Cornmiffioners and Governors of the faid R.oyal Hofpital, for the time being, to grant Leafes of the Pre- miflcs fo forfeited, and vefted in his Majefty as aforefaid, for any Term not exceeding twenty-one Yeais in Pofieffion, at thebeft and moft improved yearly Rent : And it was thereby further enaft-ed, That the Cornmiffioners or Governors of the faid Royal Hofpital fliould, and were thereby required, to contrscl and agree with able and fufficient Tradefmen, Artificers or other Perfons, for finifliing and completing the faid Royal Hofpital in a workman-like and fubftantial Manner, on the eaficft and mofc reasonable Vol. VII.
