ii6 C. 33. Anno tricefimo Georgii IL A. D. 1757. CommilTioners nor to prejudice the Navigation of thi Ouze. Limitation of Actions. General IfTue. Treble Coftj, Publick Att. Act ; and the PeiTon or Perfons to whom fuch Warrant or Warrants fliall be direfted, fhall and mav levy the Money fo expended, by Diftrefs and Sale of the fame Goods and Chattels, together with all incident Charges, in the fame Manner as the faid Rates and Taxes are herein before diredled to be levied rendering the Overplus, if any be, to the Owner or Owners thereof. XIX. Provided alfo, and it is hereby further enacted and declared, That this A6t, or any Thing here- in contained, {hall not extend, or be conrtrued to extend, to irapower the faid CommilTioners appointed' for putting this A6t in Execution, to erect or fet up any Sluice or Dam acrofs the River Ouze, or to do or perform any other Work or Works which may prejudice the Navigation of the faid River Ouzs or obftru(St or hinder any Waters from falling down the faid River, through Lynn Channel to Sea. XX. And be it further enaifted by the Authority aforefaid, That if any Action, Suit or Information fliall be commenced or profecuted againft any Perfon or Perfons for any Thing done or to be done in purfuance of this Act, and in the Execution of any of the Powers and Authorities hereby given, every fuch Action or Suit fhall be commenced within fix Calendar Months next after the Fact committed, and not afterwards ; and flKill be laid and brought in the faid County oi Nor-folk, and not elfewhere ; and the Defendant or Defendants in fuch A<£tions or Suits fhall and may plead the General IfTue ; and if in Re- plevin, may juitify and avow by Virtue of this Act, as Perfons a£ting by Authority of CommifTtoners of Sewers are enabled to do, and give this Act and the Special Matter in Evidence, without fpccially pleading the fame, other than as aforefaid, at any Trial to be had thereupon ; and that the fame was done in Purfuance and by the Authority of the faid A6t ; and if the fame {hall appear to have been lb done; or if any fuch A6tion or Suit fhall be brought after the Time before limited for bringing the fame or Ihall be brought or laid in any other County ; then the Jury fhall find for the Defendant or Defen- dants, Avowant or Avowants ; or if the PlaintifF fliall become nonfuit, or forbear Profecution, or dif- continue hi«, her or their Suit or Suits ; or if any Verdidt fliall pafs againil him, her or them; or Judg- ment be given againft him, her or them, upon a Demurrer, or otherwife ; then and in any of the faid Cafes, the Defendant or Defendants, Avowant or Avowants flball recover treble Cofts, for which he, flie or they fliall have like Remedy, as where Cofts by Law are awarded. XXI. And be it further enaded by the Authority aforefaid. That this A6t fliall be deemed, taken and allowed to be a publick A£t; and all Judges, Juftices and other Perfons are hereby required to take Nc- tice thereof as fuch_, without fpecially pleading the fame.
