Having been refused the third penny of the County of Devon by the Exchequer on the ground that he did not claim it " nomine Comitis "(») the King by writ 2-1 Sep. 1331, directed investigation to be made and by letters patent 22 Feb. 1334/5 declared him EAIIL OF DEVON or DEVONSHIRE ( h ) and that he should assume such title and style " as his ancestors, Earls of Devon, had wont to do."( c ) He m. when but 17 in 1292, Agnes, da. of John St. John, of Basing, Hants, by Alice, da. of Reginald FrrzriEns. He d. 1310 and was bur. at Cowick, near Exeter, Inq. post morlcm.3, Jan. 1310/1- His widow d. 1315 and was bur. at Cowick afsd. XI. 1340. 11 or .2. Hugh (Courtenay), Earl of Devon ami Loud CotJMBHAY, s. and h., 6. 12 July, 1303 ; served in the Scotch and French wars; Knight Banneret 20 Jany. 1327 ; drove back the French from a descent on Cornwall, 1339 ; was sum. v. p. to Pari, as a Baron;' 1 ) (Lord Courtenay) 23 April (1337) 2 Ed III, with the addition of the word "Junior; " bub sue. to the Earldom 3 years afterwards. He made, by lie. oi King Ed. Ill, an extensive entail in tail mail of his lauds. He was Joint Warden of Devon aud Cornwall, 1352 j Chief Warden of Devon, 1373. He m. 11 Aug. 1325, Margaret, 2d da. of Humphrey (de Bonus), Earl of HEREFORD and ok Essex, by the Lady Elizabeth Plantagf.net, da. of King Edward I. He d. 2 May 1377, aged 73, aud was bur. in Exeter Cathedral. Ei« widow (by whom he had S( c ) sons aud 9 daughters) d. 16 Dec. 1391 and was also far. there. M.I. Will dot. 28 Jany. 1890/1 pr. 1391. [Sir Hur.n Courtenay, styled Lord Courtenay, s. and h. ap., b. 22 March 1326/7; was K.G.( f ) 23 April 1311, being one of the Founders of that Order^'). He was in Frauce in 13 16, at the siege of Calais 1347, late in which year he distinguished himself at a tournament at Eltham. He m. in 1341, Elizabeth, da. (it is said), of Sir Guy de Bryan, of Tor Bryan, Devon. He d. v.p. before 31 Aug. 1349, and was bur. at Ford Abbey. His widow d. 23 Sep. 1375. [Hugh Courtenay, styled Lord Courtenay, s. and h. of the above Hugh and Elizabeth, and grandson and h. ap. of Hugh, Earl of Devon above named. Entering early a military life, he was Knighted by the Black Prince before Vittoria in 1367, and was at the battle of Najara the same year. He was sum. to Pari, as a BaroiiC 1 ) (Lord Courtenay) by writ S Jany. (1370/1), 44 Ed. III. He m., about 1365, Maud, da. of Thomas (Holand), Earl of Kent, by Joan (afterwards Princess ok Wales), da. of Edmund (Plantagenet), Earl of Kent. He d. s.p. 20 Feb. 1373/4, in the lifetime of his grandfather the Earl of Devon above named. His widow in. Waleran, Count of St. Paul.] (») Coll. Top. ct Gen," vol. vii, p. 118. ( b ) His summons to Pari., 24 May (1336), 10 Ed. III., runs " quod ipse, &c, vel filium simm piimogenitum ibidem mittat." ( c ] This would appear more like a restitution of the old dignity than the creation of anew Earldom. His "placing" in Farl. was, however, in 6 Ed. III., the last of all the Earls ; but in 10 Ed. III., aud afterwards, it is above several Earls, who, however, sometimes were before and sometimes after him ; so that apparently nothing can be gathered from such placing. {*) This summons, of 1337, would according to modem decisions be a summons in his father's Barony of Courtenay as c> by the writ of 1299. (°) Of these but three had issue, viz. (1) Hugh the first son (2) Edward the third ton (both mentioned in the text) and Sir Philip Courtenay, of Powderham, Devon, ancestor of the present Earls of Devon. Another son (the 4th), William Courtenay, was Archbishop of Canterbury 1381-96, while Sir Peter Courtenay, KG., the 7th sou, who d. 1409 was a highly distinguished soldier.
