His extravagant and splendid style of living caused him to alienate the lands of Erroll, so long enjoyed by his ancestors. He m. Ann, 1st da. of Patrick (Lyon), 1st Eaiu. of KrNaiioitN [S.], by Ann, da. John (Mummy), 1st Earl op TulubaKDINB [8.] He d. at Erroll, 7 and was bur. there 18 Dec. 1636. His widow d. there 8 Feb. 1637. XI. 1636. 11. Gilbert (Hat), Earl of Erroll, &c. [S.], only s, and h. ; served heir to his father and grandfather, 30 Aug. 1638 ; obtained a pension, 1639 ; was Col. of Horso in "the Engagement" to rescue King Chftrles L, in 1648 ; raised a reg. for the service of Charles II., to whom, in 1601, he was P.C. Having resigned his dignities to the Crown, he received a new grant thereof, 13 Nov. 1660, to him and the heirs of his body, which failing, to the heirs he should appoint,( b ) rem. to the heirs male and of tailzee and provision in the former limitations, rem. to his heirs male and finally to his heirs whatsoever. He IB, 7 Jan. 1658, at Kinnaird, Catharine, yst. da. of James (Carnegie), 2d Karl of So-jthf.sk [S.]. by Isabel, da. of Robert (Ker), Earl of Roxuurgu |S.] Having executed a nomination of his successor, 16 Feb. 1074, he d. within six weeks thereof s.p. His widow was, in 1689, Chief Governess to Prince James Frauds (titular Prince of Wales), at the court of St. Germain, in France, where she d. in 1093. XII. 1674. 12. Joiin (Hay), Earl of Erroll, and Hereditary Con- starle [S.], cousin and h. male, sue. to the above-named dignities by virtue of the nomination of 10 Feb. 1674, above-mentioned and had a charter of that Earldom, 4 March 1674. He was 6. about 1635, being s. and h. of Sir Andrew Hay, of Killour, by Margaret, da. of Patrick Kinnaird, of Inchture, co. Perth, which Andrew, was s. and h. of George Hay of Killour afsd., who was yst. s. of Andrew, 8th Earl of Erroll, by his second wife Agues Sinclair.( c ) He m. Ann, da. of James (Drummond), 3rd Earl of Perth, [S.], by Ann, da. of George (Gordon), 2d Marquess of Huntly [S.] She was b. Jan. 1656. He d. 30 Dec. 1704.( l1 ) XIII. 1704. 13. Charles (Hay), Earl of Erroll, &c. [S.], lsts. and h., b. about 1680. He took the oaths and his seat in Pari. 28 June 1705, warmly opposing the Union [S.], and entering, 7 Jan. 1707, a protest against it. He was made K.T.. in 1705, by the titular King James III. Being suspected of treason, he was in 1708, imprisoned in Edinburgh Castle. He d. unm. 16 Oct, XIV. 1717. 14. Mart, suo jure Countess of Erroll, &c. [S.] eldest sister and heir of line, sue. to the dignities enjoyed by her brother under the nomination of 10 Feb. 1074, abovementioned, to whom she was Berved heir, 6 Feb. 1717/8. She m. Alexander Falconer, next br. to David, 5th Loud Falconer of Halkertoun [S.] He was 6. 1682. The Countess had her claim aa High Constable [S.], allowed at the coronation, 11 Oct. 1727, of George II. Under the act, 1747, abolishing heritable jurisdictions, she received £1,200 for the regality of Slains. She d. s.p. 19 Aug. 1758, at Slains Castle, co. Aberdeen. ( c ) The descent being by this second wife and not by the first wife Jean (the heir of line of the earlier Earls of Erroll), this Earl and his posterity wore not the heirs general of those Earls. ( d ) Of the "Marl of Arrol" it is Baid in Macky's Characters (about 1702), that he " hath lived retired since the Revolution, is of a brown complexion, middle stature, towards 70 years old." (o) Macky, in his "Characters," says (about 1702) of him, that "my Lord Haye is one of the hopefullest young gentlemen in the Kingdom, and an enemy to Presbytery ; not 25 years old."
