UVIarques of Hamiltoun , and his Succeflburs , to be haldenofhis Majefty and his Hghnes Succeflburs, as [heir immediate fuperiours thereof for ever. And without prejudice to the Burgh of Edinburgh , of what- fomever rents , profits, tenements, annualrents , teind-fheaves , and other commodities given , granted land difponed to them for entertainment of their Hofpitals , Coiledge and Minifterie. And fiklike but preju- dice of whatfomever teinds , few-mail; or annualrents which perteined of auld to the faids Chapters in com- mon, or to any Prebendar in particular, difponed by his Majefty to any Coiledge within theUmverfitieof z£.-Andrewes , Mailers or Burfers thereof, which his Majefty with advice of the Eitates , declares fhall pot be prejudged by this prefent Ad. And als according to the reitriclions , exceptions and limitations con- ceived in favours ofFewars, Tackf-men, and others havand right particularly fet down and exprefled in M:he fccond Act of his Majefties eighteenth Parliament, concerning the reftitution of the Eftate of Bifhops. Uwhich reftne'tions , exceptions and limitations , are halden as repeated and exprcft in this prefent Aft. And fo the effect that all fick perfons who are and have been Tenents and Vaflals to Deanes and other Members hi Cathedral Kirks may be in certaintie known and by whom they ihould be entred and received in the lands land others halden by them of the faids Deane and Members , or any of them. Therefore it is Statute and ordeined by Our Soveraigne LORD andEftates, That when anyfik oc- eafion fhall offer of receiving or entring of Vaflals, or of changing of Tenents who comes in the Vaflals (places, either by alienation of the Vaflals, orcompryfingfromhim, or by any other lawfull manner, the (direct fuperiour of whom the faid Vaffall immediatly held , fhall be aftricled and halden to do the fame , and lo enter all fik perfons by himfelf (they doing their duetie to their fuperiours as apperteins.) In the which cafe, loUR SOVERAIGNE LORD and Eftates declares the confent of the Prelate , or remanent Mem- bers of his Chapter , no wayes to be neceffar to the faid entry or change of i ennents. And becaufe the Prio- Irie of SanCt- And/ ewes is now erected in ane Temporal Living and Lordlhip, the Prior whereof in former Itimes was ahvayes Deane of the Chapter of Si-jiS:- Jndrewes , and the Channons thereof were the Mem- Ibers of the faid Chapter which are now all abohihed , and to the effect there be not wanting ane Chapter to the faid Kirk. OUR SOVERAIGNE LORD, with advice forefaid , declare? that the Miniftcrs ferving the I cure at the Kirks under- written, prefent and to come, fhali be efteemed the Chapter thereof. OUR SOVERAIGNE LORD, with advice forefaid , declares, ftatutes and ordeines the faid Arch biihop to be elected by eight Bifhops of his Diocie. They are to fay , The Bifhop of 'Dunkeld. 1 he Biihop oiAberdein. The Bifhop of Brechin. The Bifhop of Dumblaw. The Bifhop of Rofs. The Biihop of CfrLurray. The Biihop oiOrkney , and the Bilhop oiCaithnes. And by five Minifters ferving the Cure of the Kirks under- written, to wit. The Principal of S. Leonards Coiledge. The Arch-deane of %:And-rewes, The Vicar of S.Andrewes. The Vicar of Luchars , And the Vicar of Cowper. Which Bifhops and Minifters , or the moft part of them, ihall have power in all time to come, to elect the Arch- piihop a hen ever the Sea fhall vaik, and fhall remain hereafter the Chapter appointed by our Soveraigne LORD, and Eftates, for the election forefaid.
