ACT XIV. Anent Superiorities of Kirk-lands. UR SOVERAIGNE LORD, With advice and confent of the Eftates of Parliament findes , declares , and ordaines , that his Majeftie and his Succeflbrs , have and mall have good and un doubted right to the fuperiorite of all and fundrie Lands, Baronies, Milnes, woods, fifhings, Towers, Fortalices, manour places and whole pertinents thereof, pertaining to whatfoever Abbacies, Priories , Prio- reffes , Preceptories , and whatfoever other Benefices, of whatfoever Eftate, degree , Title , Name, or de- signation the fame bee of , Erefted in Temporal Lordmips, Baronies, or livings, before or after the gene- ral annexation ot Kirk-landes , made in the Moneth ot July , one thoufand, five hundred, fourfcore and feven years , And to the whole cafualities of the faids fupenoriries , not difponed before the date of the gene- ral CommifTion , which is of the date at #%te-&z//, the feventeenth of Januarie , io^.yeares; Andalfo to the whole Few-mails , Few-fermes , and other rents and duties of the faids fuperiorities , of all yeares af- ter the date of the faid Commiflion : Referving to fuch Lords and Titulars of Erections who have iubfcribed the general Surrender, the Few-mails, and Few-fermes of their faids fuperiorities, ay and while they receave payment and fatisfaftion of the fum of one thoufand markes ufual money of Scotland, for ilk Chalder of Few- ferme victual over-head; And for ilk hundrech markes of Few-mails, and for ilk hundreth markes worth of all other conftant rent of the faids fuperiorities (not confifting in victual or money , and not being naked fer- ViceofVafTals) according to the tenour of his Majefties general determination , and conform to the conditi- ons therein contained , which are holden as repeated and expreft here. And ficklike with this declaration j that thefe prefents mall be without prejudice to the faids Lords , and Titulars of erection , of whatfoevet Lands, Baronies, Woods, Fiihings, Manour-places, Milnes, Multors, and others of the faid erected Benefi- ces, pertaining to thofe who have Surrendred, as faid is , in propertie; And whereof they had the right of propertie, the time of the faid general furrender acquired by them, either before or fince the faids erecti- ons, by whatfoever maner of way according to the Lawes of the Kingdome. Providing they hold the faid propertie of his Majeftie and his Succeflbrs , as the fame were holden before the date of the faids erections, And for payment of the Few-mails , Fe vv-ferms, and other duties mentioned in the old Infeftments of the faids lands before the date of the faids erections. AND His Majeftie and Eftates declare all rights and deeds whatfoever granted by his Majeftie , or his umwhile deareft Father , or Grand-mother , Qiieene CMarie , to whatfoever Titulars of Erections which may prejudge his Majeftie and his Succeflbrs , in the peaceable brooking, joying and pofleiling of the faids i Superiorities , and whole benefit thereof above-fpecified (under the exceptions alwaies and provifions above j written) To be null, and of none avail, force nor effect by way of action , exception, or reply : Andalfo findes and declares that the faids Lords and Titulars of erection ihall hold their propertie and proper lands, , Of his Majeftie and his Succeflbrs , as the fame were holden before the date of the faids erections. And for payment of the Few-mails, Few-fermes, and other duties mentioned in the old Infeftments of the faids i Lands granted to them and their authors before the date of the faids erections : IT IS alwayes provided, and declared, that thefe prefents , nor no claufe therein contained , mail be extended to the fuperiorities of whatfoever lands , Baronies , and others , pertaining to whatfoever Archbifhop , Bifhop , and their Chap- tors : but that the fame fliall remaine with them and their Succeflbrs unhurt or prejudged by this pre-> fent Act. A C T XV. Anent his ^Majeftie s Annuitie ofTeinds. UR SOVERAIGNE LORD, And Eftates of Parliament , Ratifies and approves the Aft of the General Commiflion of Tcinds and Surrenders , Of the date at Holy-rude-houfe the twenty ninth of May, 16x7. years, whereby it is found and ordained , That his Majeftie and his Succeflbrs ihall have the conftant rent and dutie following , payed out of the Teind Bolls of Victual, And out of the Bodie of the reft of the Teinds of the Kingdome redacted in money , Except the Teind-bolls and fit ver payed to the Bilhops, being the rent pertaining to them, in the Eftate wherein the fame is presently payed or prefently payable to them : And except the Teind-bolls and filver payed to Minifters in name of ftipend tor fervingthe cure, and to the Coiledges , Hofpitals, and other pious ufes: That is to fay , Of every Teind-boll of the beft Wheat ten millings; Of everie Boll of the beft Teind-beare , eight ihil lings; And of everie Boll of the beft Teind Oates, meale, peafe and rye, fix /hillings : And where oates are of that ■';]
