Whereby it is ordained, that the payment of the faidannuitie fhall have the beginning of the crop and yeare of God, 16x8. Together with another Acl of the faid commiffion, of the date at Holy-rudehoufe the fourteenth day of July, & i 630. Whereby letters of horning are ordained to be direct at the inftance of his Majefties Thefaurer, for payment of the faid annuitie of the crops, 1 6x8 and 1629. And yearly in time comming. Together with an Act of the convention of the Eftates, of the date at Holy-rudehoufe the twentie ninth of July, 1630 yeares, where- by the faid Eftates have ratified and approved the faid Acl: of the date and and tenour forefaid, anent letters of" horning, to be direct at the inftance of his Majefties thefaurer, for payment of his Majefties annuitie of the crops and years of God, 16x8 and 16x9. And yearly in time comming. And ficklike ratifies and ap- proves the Act of the faid commiffion, of the date the twentie third of March, 1631 years. Whereby it is ordained, that in all teinds which fhall be unvalued betwixt and the firft of Auguft thereafter, that the he- ritor fhall pay hisjuft teind according to the fifth part of the prefent rent, ay and while the conftant rent be determined. And whereby it is ftatute and ordained, that his Majeftie fhall have right to uplift his annuity according to the faid fifth part of the prefent rent, ay and while the faid conftant rent be determined, To- gether with another Act of the faid Commiffion of tiends and furrenders of the date at Holy-rudehoufe the fourteenth of December, 163 1 yeares. And ratified by the Lords of fecret Councell upon the twentieth day of the faid month of December. Whereby it is ftatute and ordained for an interim, that the annuitie of teinds, confifting in victual, fhall be payed to his Majeftie of all yeares bygone, and in time coming con- forme to the tenour of the faid laftAct: And that according to the juft and true prices of the viCtuafin ilk part of the Country,comp ting for, ilk hundred markes of the prices of the faid victual being redacted in money fix markes for his Majefties annuitie. Which Act is thereafter upon the twentieth of December, 1631. ra- tified by the Lords of fecret Councel, And letters of horning and poynding ordained to be direct thereupon, and thereafter ratified by the Lords of Exchequer upon the twentie third of the faid moneth of December! And hisMajeftie and EftatesStatute and ordaine the faid annuitie forth of the teinds to be payed to his Maieftie and his Succeflors,of the faid crop and year of God, 1 6x8 . And of all yeares fenfine and in time comming. And that afwell out of the unvalued as valued teinds conforme to the tenours of the faid Acts of convention fe- cret Councel and Exchequer. And ordaines letters of horning and poynding to be direct by the Lords of his Majefties Exchequer at the inftance of his Majefties Thefaurer, principal and depute, for payment of the faid annuitie of all years by gone and in time comming. And ordaines the Lords of his Majefties Ex- chequer, to fit at all convenient times for granting anddifcuffing of fufpenfions, touching the faidannuitie [of teinds. It is alwaies declared, that die laft claufe and article contained in the faid Act of annuitie, where- by the Commiffioners thinke fit that the faid annuitie of teinds fhall bee annexed to the Crowne, isnowaies ratified by this prefent Act , nor no claufe thereof. And that his Majeftie takes to his own gracious confi- Lkration what to do thereanent in whole or in part, as his Majeftie in his royall wifdome fhall thinke moft expedient. And whatever his Majeftie fhall do now or hereafter thereanent, fhall be as valid and effectual i*s if the fame had been particularly expreft in this prefent Act. ACT XVI. lo hnent Vaffals Holding Ward. URSOVERAIGNE LORD, And Eftates of this prefent Parliament, ratifie and approve the Act of ) Parliament made by his Majefties umwhile Father, of eternal memorie, 18, Parliament cao . Intitulate, Act anent fetting of fewes to fub-vaffals of ward lands in the whole heads' and articles thereof knd farther, his Majeftie with confent of the faid Eftates, hath extended and doth extend the faid Act of parliament and benefit thereof, in favour of his facred Majeftie and of the Prince of Scotland and their Kucceflbrs in all time coming: And ftatutes and ordains, that it fhall no wayes be lawful towhatfoever Wafials, holding lands of his Majeftie or of the Prince of Scotland, or of any Duke, Marqueffe Earle n/icount, Lord, Prelate, Baron, or any other perfon whatfoever, holding their land of their Superiours by fervice of ward and reliefe, to fet their faid lands, baronies, milnes , nfhings , or any other lands or heritages whatfoever,holding ward/as faid is, To any other perfon or perfons in Few for payment of a Fewfer- kne dutie , or in any manner of holding,in prejudice of the faid ward holding, without fpecial advice andconfent (of their fuperiours, of whom they hold the fame r effective-. And refcinds and annulls all former Acts of Parli- ament of whatfoever date or tenor, which may in any fort derogateto this prefent Act.
