Submiſſion made be the Burrowes, To his Majeſty, Anent their Teinds.

AT PERTH, The Second Day of July 1628 years, Wee the Commiſſioners of the Free Royal Burrowes of Scotland, under-Subſcribing, having full Power, and Commiſſion, from Our ſeveral Burghs under-written, for their Right to the Teinds, great, and ſmall, Parſonage, and Viccarage, of all, and whatſoever Benefices, doted be his Majeſties moſt Royal Progenitours, be Vertue of the Acts of Parliament, and Securities made to them, and ilk one of them, for their own parts reſpective, for Suſtentation of the Miniſtrie, Colledges, Schools, and Hoſpitals, of the ſeveral Burghs under-ſpecified, to the effect aftermentioned. CONSIDERING, That his Sacred Majeſty; Our Dread Soveraign, Out of his Fatherly, and tender affection, and Royal care to the publick good of all his Majeſties Subjects, of his Majeſties Native, and Ancient Kingdom of Scotland, for freeing them from the extremity, and damage, which may enſue to them, by leading of their Teinds, Intends to take such courſe, as hereafter ilk Man may poſſeſs and enjoy the Teinds of the Lands pertaining to him in property. AND Wee acknowledging our ſelvs to be bound in dewty, to the advancement of all his Majeſties Royal deſigns, tending to ſo publick a good; THEREFORE to be Bound, and Oblidged, Likeas Wee, and ilk ane of us for our own Burghs reſpective under-wtiten, Binds, and Oblidges Us, and Our Succeſſours, to grant unto the Heretours of the ſeveral Lands, whereof the Teinds doth to Us appertain, after the expiring of the preſent Tacks already granted be Us, to the preſent Tackſ-men, ſuch Rights, and Securities, for perpetual enjoying of their own Teinds, and for payment of ſuch Rates, and Teind Rental, and Teind Bolls of Victual, as his Majeſty in His Royal Judgment ſhall decern; Wee Submiting our ſelves, ilk ane of us for our own parts hereanent, To his Majeſties Royall Decreet, and Sentence, and what ſhall be the true Rate, Eſtimation, and Quantity of the ſaids Teinds, and what Secuity ſhall be made to Us, be the ſaids Heretours, for yearly payment to be made to Us, ilk ane of Us for our own parts, of the ſaids Teind-Bols of Victual, of ſuch forts, as ſhall grow upon the ſame Lands yearly, as ſhall be decerned by his Majeſty, betwixt zuile and Candlemes, for payment whereof, the ſame Lands ſhall be lyable, and bound in ſecurity for the ſame. And are content, and conſents, ilk ane of Us, for our own parts, That his Sacred Majeſty give forth his pleaſure, and determination, anent the premiſes, Referred to his Majeſty in manner foreſaid, betwixt the day, and date hereof, and the laſt day of December, in the year of God 1629, as ſhall ſeem good to his Majeſty. With power alſo to his Majeſty, to prorogat the time of the giving forth of his ſaid determination, to whatſoever day, or dayes thereafter, as ſhall ſeem good to his Majeſty, out of his Royall Wiſdom, And farther Binds, and Oblidges Us, and Our Succeſſours, ilk ane of Us for our own parts, and Burghs, reſpective under-written, In caſe it ſhall be found, that the Rents of the Teinds, great, or ſmall, Victual, or Silver Dewty of the ſame, doted for Satiſfaction of the Miniſters, Rectors, and Regents of Our Colledges, Maſters of Our Schools, and Poor of Our Hoſpitals of Our ſeveral Burghs, payed to Us, ſhall exceed the ſeveral Sums of Money expended be Us, for the foreſaids Pious Uſes, and their entertainment in the Stipends of the ſaids Miniſters, Rectors; Regents of Our Colledges, Maſters of Our Schools, and of Our Poor, and of or ſaids Hoſpitals, then, and in that caſe, to pay yearly to his Majeſty, and his Collectours, ilk ane of them for their own parts, forth of the ſuper-plus and excreſce of the ſaids dewties remaining, by and attour the payment of the Stipends of the ſaids Miniſters, Rectors, and Regents of our ſaids Colledges, Maſters of Our Schools, and entertainment of the Poor in our ſaids Hoſpitals, out of ilk Boll of beſt Wheat, Ten ſhillings, and out of ilk Boll of beſt Bear, Eight ſhillings, And out of ilk Boll of beſt Oats, Peaſe, and Meale, Sex Shillings, and the ſaid Rent to be Modified out of the whole Reſt of the Teind-Bols of Victual of theſe Teinds foreſaids, being of inferiour worth, goodneſs, and prices, According to the proportion of the ſaid dewty, and rent, made, and impoſed upon the beſt Boll of every kind in manner foreſaid. And where Oats are of the Nature that they will not render above halfe Meale, the Rent to be Three ſhillings, And of every Hundred Merks of Perſonage, and Viccarage Teinds, which are not of Victual, the Sum of Six Merks money, of yearly Rent, and Dewry. AND FOR the more Security, Wee are content, and conſents, that thir preſents, with his Majeſties determination to follow hereupon, ſhall be Inſert, and Regiſtrat in the Books of Council, and Seſſion, and ſhall have the Strength of a decreet of the Lords thereof, with Execution to follow thereupon, in form as effeirs, And the Horning to paſs thereupon, On a ſimple Charge of Ten Dayes allennerly: And to that effect, Makes and Conſtituts
