THe Kings moft excellent Majefty taking to His consideration, how much His own honour, the general good oi the Kingdom, and the particular interefts of His Subjects , of all ranks within the lame , are concerned, in the feeedy and equal adminiftration of Juftice; and how neceiTar it is, in order thereunto, that the Senators of the Coiledge of Juftice, who are the only ordinarfupream Judges of this Realm , in all Civil caufes, be provided with a competent and futeable allowance for the defraying of the charge and ex- pence they are put to , in their attendance on the difcharge of that publick Truft; Hath therefore , out of His princely care , thought fit to grant the faids Senators of the Coiledge of Juftice , an addition of ten thoufand .pounds Scots to be payed unto them yearly, and that over and above the former Annuity often thoufand pounds granted by His Royal Grand-father , in the year one thoufand , fix hundred , and nine , or what hath been formerly granted to them in this or any other Parliament , or otherwayes doth appertain to them. And His Majefty confidering , that this grant will much tend to the profit , advantage and good of His Majefties fervice and well-fare of His Kingdom , Doth therefore , with advice and content of his Eftates of Parliament appoint the fame to be payed out oftheCuftoms of this Kingdom: And for that end , His Majefty , with advice forefaid , and after mature deliberation had thereupon , difiblves , annuls and infringes from the Crown and Patrimony thereof, the annexation of the Cuftoms of this Realm , in fo far as the fame may be extended to the faidfum often thoufand pounds, of the firft and readieft of the Cuftoms. And now after this diflblution , His Majefty , with advice forefaid , gives , grants , aftignes and difpones to the faids ordi- nar Lords and Senators of the Coiledge of Juftice , and their Succeflbrs in the faid Office and Truft., in all time coming, .all and whole the fum often thoufand pounds ufual money of Scotland , to be uplifted and re- ceaved by them , : and their Col lectors appointed by them , at two termes in the year , Whitfunday and Mer- timafs, by equal portions, forth of the firft and readieft oi His Majefties Cuftoms , or any part thereof fzom his Majefties Thefaurer, Deput-thefaurer , Receavers, Tackf-men, Pofleflors , Intromettors with the faids Cuftoms, and others lyable in paiment thereof, prefentand to come; beginning the firft termes paimentthereoffromthefeaftandtermeofMertimafslaft bypaft, one thoufand, fix hundred, and fixtv one years, and fo forth, yearly and termly thereafter at the termes forefaids in all time coming; charging herefore the faid Thefaurer , Deputy-thefaurer , Receavers , Tackf-men , Pofleflbrs , Intromettors with the faids Cuftoms , and others lyable in paiment thereof, prefent and to come , to make thankful paiment at the termes of paiment above- written, of the forefaid yearly fum often thoufand pounds to the faids ordinar Lords of Council and Seffion, their Succeflbrs and Collectors in their names , our of the firft and readieft of the faids Cuftoms; and that they be preferred in paiment thereof to all and whatfoever other perfbn or per- fons pretending right to the faids Cuftoms or any part thereof by penfion, affignation, gift, or other right or dilpofition whatfoever. And likewayes commanding the Lordsof Exchequer , prefent and to come to allow the fame to the payers of the faid fum of ten thoufand pounds , yearly and termely , in the firft end of their accounts , upon fight of the faids Lords of Seftion , or their faids Collectors acquittance upon pai- ment thereof. And alfo , His Majefty , with advice and confent forefaid , Decerns and Ordains His Ma- jefties Thefaurer , Deput-thefaurer, Receavers, Tackf-men of, and Intrometters with the faids Cuftoms prefent and to come , to become enacled themfelves and find fuffkient caution , a&ed in the Books of Coun' cil and SefTion , for the yearly paiment of the forefaid fum of ten thoufand pounds to the faids Lords of SeiTi" on and their Succeflbrs , or their Collectors , at the termes and in manner above-expreft : And atrhe h ceafe or dimiffionofany of the perfonsfo enacled, that the next entrant fliali become enacled, and find tiOn to the effecl: forefaid. As alfo, at the letting of any new Tacks, the Tackf-men find caution to tl " effecl: forefaid; otherwayes , the faids whole Tacks.to be null , and the nullity thereof to be decided 1 either of aclion or exception : And that Letters and Executorial of Horning , upon an charge often da ^ be directed againft them, by deliverance of the faids Lords of Seffion, for paiment of the faid fum of t^' thoufand pounds in manner above-written. A nd Decernes and Ordains , That no Sufpenfion be granted ^° this matter, to whatfoever perfon or for whatfeeyercaufe, by the Lords of Parliament, Lords of E le* quer , or other Judge whatloever , except upon confignation of the funis charged for , or production of Tuffi- cient acquittances; and that the faids ordinar Lords and Senators of the Coiledge of Juftice are and il all be , only Judges for difcuffing of the faids Sufpenfions , difcharging all other Judges ofgrantincr Sufpenfions concerning the premifTes and difcufiing of the fame, and of their Offices in that part for ever.* 3 And to tie forefaid Difpofition and Atlignation of ten thoufand pounds, and to the whole Heads and Articles of this Act above written , His Majefty and Eftates of Parliament interpones their Confent and Authority as to an Act which doth highly concern the good and well-fare of the Narion. And His Majefty for his Hisl - nefs and His Succeflbrs promifes, in verba Vrmcipis , never to impugn or quarrel the fame nor come in the contrair thereof, directly nor indirectly, in time coming, and the like execution being granted by Act of
