SEC.1 1 02 . T E MPORA R YDI SCRETIO N ARY A U T H ORITY TO G RANT A L LO W ANCES ,B ENE F ITS, AND GRATUITIES TO PER - SONNEL ON OFFICIAL DUTY IN A COMBAT Z ONE. (a) I N G ENE R AL.—Section 1 603 (a) of the E mergency Supple- mental A ppropriations Act for Defense, the Global W ar on Terror, and H urricane Recovery, 2 006 (Public L a w 10 9– 23 4; 120 Stat. 443) is amended— (1) by stri k ing ‘ ‘During fiscal years 2006, 200 7 , and 200 8’ ’ and inserting ‘‘(1) During fiscal years 2006 (including the period beginning on October 1, 2005, and ending on J une 15, 2006), 2007, and 2008’’; and (2) by adding at the end the following
‘‘(2) During fiscal years 2009, 2010, and 2011, the head of an agency may, in the agency head’s discretion, provide to an individual employed by, or assigned or detailed to, such agency allowances, benefits, and gratuities comparable to those provided by the Secretary of State to members of the F oreign Service under section 413 and chapter 9 of title I of the Foreign Service Act of 1980, if such individual is on official duty in a combat z one (as defined by section 112(c) of the Internal Revenue Code of 1986).’’. (b) E F FE C TI V E DATE.—The amendments made by subsection (a) shall take effect as if included in the enactment of the Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and Hurricane Recovery, 2006 (Public Law 109–234). SEC. 110 3 . ELECTION OF INSURANCE CO V ERAGE BY FEDERAL CIVILIAN EMPLOYEES DEPLOYED IN SUPPORT OF A CONTINGENCY OPERATION. (a) AUTO M ATIC COVERAGE.—Section 8702(c) of title 5, United States Code, is amended— (1) by inserting ‘‘an employee who is deployed in support of a contingency operation (as that term is defined in section 101(a)(13) of title 10) or’’ after ‘‘subsection (b),’’; and (2) by striking ‘‘the date of the’’ and inserting ‘‘the date of notification of deployment or’’. (b) O P TIONAL INSURANCE.—Section 8714a(b) of such title is amended— (1) by designating the text as paragraph (2); and (2) by inserting before paragraph (2), as so designated, the following new paragraph (1): ‘‘(1) An employee who is deployed in support of a contingency operation (as that term is defined in section 101(a)(13) of title 10) or an employee of the Department of Defense who is designated as emergency essential under section 1580 of title 10 shall be insured under the policy of insurance under this section if the employee, within 60 days after the date of notification of deployment or designation, elects to be insured under the policy of insurance.
