(b) M A T C H IN GR EQ U IRE M ENT.—Funds appropriated in this title for assistance for Iraq shall be made available in accordance w ith the D epartment of State ’ s A pril 9 , 2 009, ‘ ‘Guidelines for Government of Iraq Financial P articipation in U nited States Government - Funded C ivilian Forei g n Assistance Programs and Pro j ects’’. (c) O THER A S SISTANCE.—Of the funds appropriated in this title under the heading ‘‘ E conomic Support Fund’’, not less than $ 1 5 ,000,000 shall be made available for targeted development pro- grams and activities in areas of conflict in Iraq, and the responsi- bilit y for policy decisions and justifications for the use of such funds shall be the responsibility of the United States Chief of Mission in Iraq. P R O HI B ITION ON ASSISTANCE TO HAMAS SEC. 110 7 . (a) N one of the funds appropriated in this title may be made available for assistance to H amas, or any entity effectively controlled by Hamas or any power-sharing government of which Hamas is a member. (b) Notwithstanding the limitation of subsection (a), assistance may be provided to a power-sharing government only if the Presi- dent certifies in writing and reports to the Committees on Appro- priations that such government, including all of its ministers or such equivalent, has publicly accepted and is complying with the principles contained in section 620 K (b)(1)(A) and ( B ) of the Foreign Assistance Act of 1961. (c) T he President may exercise the authority in section 620K(e) of the Foreign Assistance Act as added by the Palestinian Anti- Terrorism Act of 2006 (Public L aw 109 –4 46) with respect to this section. (d) W henever the certification pursuant to subsection (b) is exercised, the Secretary of State shall submit a report to the Committees on Appropriations within 120 days of the certification and every quarter thereafter on whether such government, including all of its ministers or such equivalent, are continuing to comply with the principles contained in section 620K(b)(1)(A) and (B) of the Foreign Assistance Act of 1961. The report shall also detail the amount, purposes and delivery mechanisms for any assistance provided pursuant to the abovementioned certification and a full accounting of any direct support of such government. TERMS AN D CONDITIONS SEC. 110 8 . Unless otherwise provided for in this Act, funds appropriated or otherwise made available in this title shall be available under the authorities and conditions provided in the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2009 (division H of Public Law 111–8), except that sections 7070(e), with respect to funds made available for macroeconomic growth assistance for Z imbabwe, and 7042(a) and (c) of such Act shall not apply to funds made available in this title.
