Be it enacted by the Senate and House ofltqoresentatéves oft/le United [ ] States of America in Congress assembled, That the commissioners §§{§§§,‘{,R{§g{;m _ court of Baldwin County, in the State of Alabama, be, and they are Mn-. may bridge, it hereby, authorized and empowered to construct, maintain, and o crate wm" F°"’° a bridge over and across Perdido River at or near a point called lgaters Ferry, in the State of Alabama. Sec. 2. That any brid e constructed under the authority of this Act ,p“{,°;$,'§$;,f‘ w'" °° shall be built and located under and subject to such regulations for the ` security of the navigation of said river as the Secretary of War' shall prescribe, and to secure such object said commissioners shall submit to the Secretary of War for his examination and approval a desi n and drawin of the bridge and piers and a map of the location; and until the said plan and location are approved by the Secretary of War the bridge shall not be commenced or built; and should any change be °““”g°“· made in the plan of said bridge during construction or after completion, such c ange shall be likewise sub`ect to the approval of the Secretary of War, and any changes in said bridge r·equired by the Secretary of War at any time shall be made promptl by the said com- _ missioners’ cour·t of Baldwin County: Provided, Clyhat if the bridge €'pZ,'{,"§’f,é d,,,,,_ herein authorized be built as a drawbridge, the draw shall be opened promptly upon reasonable signals for the passagle of boats, and whatever 'nd of bridge is built the owners thereof s all maintain thereon, from sunset to sunrise, such lights and other signals as the Light- U‘”°”·°‘°· . House Board shall prescribe. Sec. 3. That all railroad companies desiring the use of the bridge U’°"’°“‘°"°"’“· authorized by this Act shall have and be entitled to equal- rights and privileges relative to the passage of railway trains or cars over the same and over the approaches thereto upon the payment of a reasonable compensation for such use; and in case the owners of said bridge and °°“‘*’°""°°“· the several railroad com nies, or any one of them, desiring such use shall fail to agree upon the sum or sums to be paid and upon rules and conditions to which each shall conform in using said bridge, all matters at issue between them shall be decided b the Secretary of War upon a hearing of the allegations and proofls of the parties; and equal ,,,g`hj°¤’*P”· °*°-· privileges in the use of said bridge shall be granted to all telegraph and telephone companies. Sec. 4. That the bridge constructed, maintained, and operated under- _,,‘;,"p‘;é‘;},ug;m°°°¤ this Act and accordin to its limitations shall be a law ul structure, ` and shall be recognized? and known as a post route, upon which also no higher charge shall be made for the transportation over the same of the mails, the troops, and the munitions o war of the United States than the rate per mile paid for the transportation of said mails, troops and munitions over the railroads and public highways leading to said bridge; and the United States shall have the right of way for postal _ telegraph and telephone puirlposem over said bridge. _ Sec. 5. That this Act sh be null and void if actual construction of ,_,§,‘f"° °‘ °°““°"“°" the bridge herein authorized be not commenced within one year and completed within three years from the date of approval thereof.
