1077 whether in its opinion legislation should be enacted (1) authorizing the Commission to declare any such transactions void or to permit such transactions to be carried out subject to such modification of their t erms a nd con dition s as t he Com mission shall deem desira ble in the public interest ; and/or (2) subjecting such transactions to the approval of the Commission where the person furnishing or seeking to furnish the equipment, supplies, research, services, finances, credit, or personnel is a person directly or indirectly controlling or con- trolled by, or under direct or indirect common control with, such carrier ; and/or (3) authorizing the Commission to require that all or any transactions of carriers involving the furnishing of equip- ment, supplies, research, services, finances, credit, or personnel to such carrier be upon competitive bids on such terms and conditions and subject to such regulations as it shall prescribe as necessary in the publi c interes t . (b) The Commission shall investigate the methods by which and garding services ogwire the e xtent to w hich wire tele phon e com panie s are fur nishi ng wi re telephone and tele- telegraph service and wire telegraph companies are furnishing wire graph companies . telephone service, and shall report its findings to Congress, together with its recommendations as to whether additional legislation on this subject is desirable . receivers and trustees . SEC . 216 . The provisions of this Act shall apply to all receivers and operating trustees of carriers subject to this Act to the same extent that it applies to carriers . LIABILITY OF CARRIER FOR ACTS AND OMISSIONS OF AGENTS SEC . 217 . In construing and enforcing the provisions of this Act, the act , omis sion, or fai lure o f any officer , agen t, or other person acting for or employed by any common carrier or user, acting within the scope of his employment, shall in every case be also deemed to be the act, omission, or failure of such carrier or user as well as that of the person . INQUIRIES INTO MANAGEMENT SEC . 218 . The Commission may inquire into the management of the busin ess of al l carrier s subject to this Act, and shall kee p itself informed as to the manner and method in which the same is con- ducted and as to technical developments and improvements in wire and radio communication and radio transmission of energy to the end that the benefits of new inventions and developments may be made available to the people of the United States . The Commission may obtain from such carriers and from persons directly or indirectly controlling or controlled by, or under direct or indirect common con- trol with, such carriers full and complete information necessary to enable the Commission to perform the duties and carry out the objects for which it was created . ANNUAL AND OTHER R EPORTS SEC . 2 19 . (a) The Commission is authorized to require annual reports under oath from all carriers subject to this Act, and from persons directly or indirectly controlling or controlled by, or under Repor t of restr ictiv e contr acts of carr iers .
