305 [CHAPTER 155 .] AN ACT May 28, 1935 . To authorize the Secretary of Co mmerce to dispose o f certain lighthous e reser- [ H . R . 7 13 1 . ] vations, and for other purposes .
[Public, No. 81 .] B e it en acted by the Se nate an d House of Repr esentati ves of the United States of America in Congress assembled, That the Secretary of Commerce is hereby authorized to convey to the State of Calif or- nia, for public-park purposes, the Morro Rock Lighthouse Reserva- tion located at the entrance of Estero Bay, Coast of California, comprising about thirty and fifty-six one-hundredths acres, with the exc eptio n of three areas each one hundre d fee t squ are lo cated , res pec- tively, on the northern side, the highest point of the rock, and the southerly side, together with rights of ingress and egress thereto as may be necessary for the establishment and maintenance of future aids to navigation at these points . The deed of conveyance shall describe by metes and bo unds insofar as p racticable the po rtion of the rese rvation transfer red, and the cond itions imposed by section 36 of this Act. SEC . 2 . The Secretary of Commerce is authorized to reconvey to the State of Delaware the abandoned lighthouse reservation about ten acres in extent, known as the " Delaware Brea kwat er Range Rear Lighthouse Reservation ", Delaware, the land being no longer required for lighthouse purposes, as stipulated in the original deed of conveyance to the United States . SE C . 3 . The S ecretary of Comme rce is authorized to convey to the city commission of the city of Saint Augustine, Florida, for public- park purposes, that portion of the Anastasia Island Lighthouse Res- erv ation , Flo rida, which is n ot re quired to b e ret ained for l ighth ouse purposes, consisting of lots 1 and 2, section 21, township 7 south, range 30 east, Tallahassee, Florida, excepting that part of lot 2 between the five-acre li ghthouse tract an d the hard-surfac ed road, together with a perpetual easement for beams of light across any part of the land that may be between the lighthouse and the sea Provided, That no conveyance of the property shall be made until such time as the city commission of the city of Saint Augustine shall have agreed in writing to relieve the United States from being a party to any claims or litigation through the acquisition of the land in quest ion by the city of Saint Augustine, and that satisfactory agreements are reached with holders of record to subdivided lands insaidlots1and2priorto1923. The deed of conveyance shall desc ribe by metes an d bounds the exac t portions of the reservation transferred, and the conditions imposed by section 36 of this Act . SE C . 4. T he Secretary of C ommerce is author ized to convey to the State of Florida for public-roadway ,, purposes that portion of the Crooked River Range Lighthouse eservation, Florida, near the southern boundary of the reservation, which is not required to be retained for lighthouse purposes, consisting of a strip of la nd approximately sixty-six feet in width and five hundred feet in length . The deed of conveyance s hall describe by metes and bounds the por- tion of the reservation transferred and the conditions imposed by section 36 of this Act . SEC . 5 . T he Secretary of C ommerce is author ized to convey to the town of Castine, Maine, for public-park purposes, that portion of the Dice Head Li ghthouse Reservat ion, Maine, which is not required for lighthouse purposes, containing about three acres and including appurtenant structures thereon, excepting the light tower and the plot of land surrounding same one hundred feet square, together with the rights of ingres s and egress as m ay be necessary f or the main- tenance of the light .
