No. 337



Whereas it is found that there are persons born in the Kingdom of Thailand to the alien fathers or mothers who unlawfully stayed in the Kingdom of Thailand according to the law on immigration or born to the alien fathers or mothers who were permitted to provisionally or individually stay in the Kingdom on exceptional grounds, but these persons, despite being Thai nationals, are never loyal to Thailand and should therefore be deprived of Thai nationality, so that national security can be protected and preserved; the Leader of the Revolutionary Council hereby delivers the following order:


Article 1

A person born in the Kingdom of Thailand to an alien father or to an alien mother without legitimate father shall be deprived of Thai nationality, if at the time of his birth his father or mother:

(1) was individually permitted to stay in the Kingdom of Thailand on exceptional grounds;

(2) was permitted to stay in the Kingdom of Thailand for a provisional period of time; or

(3) stayed in the Kingdom of Thailand without permission pursuant to the law on immigration;

Save where the Minister of Interior finds appropriate and gives a different order with individual effect.


Article 2

A person who falls under article 1 and is born in the Kingdom of Thailand following the entry into operation of this Revolutionary Council Announcement shall not acquire Thai nationality, save where the Minister of Interior finds appropriate and gives a different order with individual effect.


Article 3

All provisions of any other laws, regulations and ordinances which deal with this Revolutionary Council Announcement or are contrary to or inconsistent with this Revolutionary Council Announcement shall be replaced by this Revolutionary Council Announcement.


Article 4

The Minister of Interior shall be in charge of this Revolutionary Council Announcement.


Article 5

This Revolutionary Council Announcement shall enter into operation as from the day following the date of its publication in the Government Gazette.
