Being the 63rd Year of our Reign.

Phra Bat Somdet Phra Paraminthra Maha Bhumibol Adulyadej is graciously pleased to proclaim that:

Whereas it is desirable to revise the law on student uniform;

And whereas it is aware that this Act contains certain provisions giving rise to the restriction of personal rights and liberties, in respect of which section 29 incorporating section 32 of the Constitution of the Kingdom of Thailand so permit by means of the legal provisions;

Be it enacted by the King's most Excellent Majesty, by and with the advice and consent of the National Legislative Assembly, as follows:

§ 1

This Act shall be cited as the "Student Uniform Act, BE 2551 (2008)".

§ 2

This Act shall come into force as from the day following the date of its publication in the Government Gazette.^[1]

§ 3

The Student Uniform Act, Buddhist Era 2482 (1939), shall be repealed.

§ 4

In this Act:

"Student" means a person attending a fundamental education institute or higher education institute which provides education under degree level pursuant to the law on national education;

"Education institute" means an education institute under the law on national education, but not including a higher education institute which provides degree level education;

"Student uniform" means a set of clothes, supplementary items and other symbols which a student is required to wear by this Act.

§ 5

A student shall wear a student uniform.

The Ministry of Education shall lay down the rules governing the appearance of a student uniform, as well as the methods, conditions and exemption of wearing a student uniform.

Any student who fails to wear a student uniform without exemption under paragraph 2 may be liable to the disciplinary penalties determined by the Ministry of Education.

§ 6

Any education institute wishing to use a student uniform other than that determined in virtue of section 5, paragraph 2, shall apply to the Ministry of Education for permission, subject to the rules issued by the Ministry of Education.

§ 7

Any person who wears a student uniform without authorisation or wears any cloth similar to a student uniform, for the purpose of deceiving another into believing him to be a student, shall be liable to a fine not exceeding one thousand baht.

§ 8

All rules, announcements and orders which are issued in accordance with the Student Uniform Act, Buddhist Era 2482 (1939), and are in operation prior to the coming into force of this Act shall remain effective to the extent not contrary to or inconsistent with this Act, until they are replaced by the rules laid down by virtue of this Act.

§ 9

The Minister of Education shall be in charge of this Act.

Statement of Grounds

The grounds for promulgation of this Act are as follows: As the Student Uniform Act, Buddhist Era 2482 (1939), has been in force for so long, certain provisions do not suit the prevailing circumstances and need to be revised. In this respect, it ought to determine a standard student uniform, for the sake of economy and regularity, and with a view to nurturing the students’ disciplines and prohibiting an unauthorised person from wearing a student uniform. It is therefore necessary to enact this Act.
