Succession to estate is protected. The rights of a person to succeed to estate shall be as prescribed by the law.

No immovable property shall be expropriated, save by virtue of the power under a provision of law and only for an activity of public utility, or for a necessary activity of defending the Country or acquiring a natural resource, or for town planning, or for development of agriculture or industry, or for land reform, or for other public benefit, in respect of which indemnity must, within due time, be provided to the owners and right holders who suffer damage from the expropriation. This shall be as specified by the law.

In designating the indemnity under paragraph 3, regard shall be had to the acquisition, condition, and location of the immovable property, in addition to the reasons and objectives of the expropriation, so as to bring about fairness to the society.

Section40.Persons have the freedom of speech, writing, printing, and publication.

This freedom shall not be restricted, save by virtue of the power under a provision of law and only for maintaining
