C. 3. 119 quaint fuch Officer or Officers with the Accounts or Debts (if any fhall be) between them and the Of- ficers and Soldiers fo quartered in their refpecEtive Houfes; which Accounts thefaid Officer or Officers are hereby required to accept of, and immediately pay the fame, before any Part of the faid Pay or Sub- fiftence be diftributed either to the Officers or Soldiers : Provided the faid Accounts exceed not, for Rates of Subfiftence to a Commiffion Officer of Horfe, being under the Degree of a Captain, for fuch Officer's Diet and be paH to Innkeepers, Small Beer, per Diem, two Shillings; nor for one Commiffion Officer of Dragoons, being under &c. for Soldiers Quarters, the Degree of a Captain, for fuch Officer's Diet and Small Beer, per Diem, one Shilling; nor for one Commiffion Officer of Foot, under the Degree of a Captain, for fuch Officer's Diet and $mall Beer, per Diem, one Shilling ; and if fuch Officer fhall have a Horfe or Horfes, for each Plorfe or Horfes, for their Hay and Straw, per Diem, fix Pence ; nor for one Light Horfeman's Diet and Small Beer, per Diem, fix Pence ; and Hay and Straw for his Horfe, per Diem, fix Pence ; nor for one Dra- foon's Diet and Small Beer, per Diem, fix Pence; and Hay and Straw for his Horfe, per Diem, fix ence ; nor for one Foot Soldier's Diet and Small Beer, per Diem, four Pence: And if any Officer or Officers, as aforefaid, fhall not give Notice as aforefaid, and fhall not immediately, upon producing Penalty on Officers not fuch Account ftated, fatisfy, content and pay the fame ; upon Complaint and Oath made thereof, by paying Subfiftmce- any two Witneffes, at the next Quarter Seffions for the County or City where fuch Quarters were monc >'- (which Oath the Juftices of the Peace at fuch Seffions are hereby authorized and required to admi- nifter) the Paymafter or Paymafters of his Majefty's Guards and Garrifons, and Marines, are hereby required and authorized (upon Certificate of the faid Juftices before whom fuch Oath was made, of the Sum due upon fuch Accounts, and the Perfons to whom the fame is owing ) to pay and fatisfy the faid Sums out of the Arrears due to the faid Officer or Officers, upon Penalty that fuch Paymafter or Paymafters fhall forfeit their refpeclive Place or Places of Paymafter or Pay- mafters, and be difcharged from holding the fame for the future: And in cafe there fhall be no Arrears due to the faid Officer or Officers, then the faid Paymafter or Paymafters are hereby authorized and required to deduct the Sums he or they fhall pay, purfuant to the Certificate of the faid Juftices, out of the next Pay or Subfiftence- money of the Regiment to which fuch Officer or Officers fhall belong ; and fuch Officer or Officers fhall, for every fuch Offence, or for neglecting to give Notice of the Receipt of fuch Pay or Subfiftence-money, as aforefaid, be deemed and taken, and are hereby declared ipfofaiio cafhiered. And where it fhall happen that the Subfiftence-money due to any Officer or Soldier fhall, by occafion of any Accident, not be paid to fuch Officer or Soldier, or fuch Officer or Soldier fhall neglect to pay the fame, fo that Quarters can- not be or are not paid, as this Act directs ; and where any Horfe', Foot or Dragoons fhall be upon their March, fo that no Subfiftence can then be remitted to them, to make Payment as this ArSt, directs, or they fhall neglect to pay the fame ; in every fuch Cafe, it is hereby further enacted, That every fuch Officer fhall, before his or their Departure out of his or their Quarters, where fuch Re- On Nonpayment of giment, Troop or Company fhall remain for any Time whatfoever, make up the Accounts, as this Oysters, the officer to Aift directs, with every Perfon with whom fuch Regiment, Troop or Company fhall have quartered, ^ e up ccounts » and fign a Certificate thereof, and give the faid Certificate fo by him figned to the Party to whom fuch Money is due, with the Name of fuch Regiment, Troop or Company to which he or they fhall belong ; to the end the faid Certificate may be forthwith transmitted to the Paymafter of his Majefty's Guards and Garrifons, or to the Paymafter of the Marines, who are hereby required immediately to make Payment thereof to the Perfon or Perfons to whom fuch Money fhall be due, to the end the fame may be applied to fuch Regiment, Troop or Company refpedtively, under pain as is before in this Act directed for Nonpayment of Quarters. XXXIV. And be it further enacted, That no CommiiTary fhall mufter any Regiment, Troop or N ? Mufter in Weft- Company, within the City of TVeJiminJier, and Borough of Southwark, and Liberties thereof, but in Xp^'fentTof "wo" the Prefence of two or more Juftices of the Peace, not being Officers of the Army, under the before- or more juftices. : mentioned Penalty; unlefs fuch Juftices, upon forty-eight Hours Notice given to fix of his Majefty's Juftices of the Peace, refiding within the City and Liberties aforefaid refpectively, fhall neglect to attend fuch Mufter; and in cafe of fuch Neglect, fuch Commiffary may proceed to mufter fuch Re- giment, Troop or Company : Provided that Oath be made before any of his Majefty's Juftices of the Peace, within forty-eight Hours after fuch Mufter taken, that fuch Notice was given to fix Juftices of the Peace, as aforefaid : Which Juftices fo attending, are hereby impowered to fign the faid Mufter-rolls, and to take Cognizance of fuch Mufter, and to examine the Truth thereof, before* they fign the fame. XXXV. And be it further enafled and declared by the Authority aforefaid, That it fhall and ..mayi ^° nftables ' K & f ■ ™V_ be lawful to and for the High Conftables, Petty Conftables, Headboroughs and Tythingmen, within m{ ^° s ?" m el * the faid City and Liberties of TVeJiminJier, and Places adjacent, when thereunto lawfully required, to billet and quarter the Officers and Soldiers of his Majefty's faid Regiments of Foot Guards, in fuch Houfes only, as by this Act are limited, in and about the faid City and Liberties of TVeJiminJier, and Places adjacent (except the City of London) during the Continuar.ee of this Act : And when any Order fhall iffue for the quartering or billeting any Officers or Soldiers within the faid City and Liber- Petty Conftables, &c. of Foot Guards on fuch Houfes only as by this Act is limned within his refpective Parifn, Hamlet or Diftrict; and fuch Petty Conftables, Headboroughs and Tythingmen fhall, in purfuance thereof,, 3 billet
