Pagani, D'n's de Lammer ") to the celebrated letter in 1301 to the Pope.(») Ho Hi. Isabel, da. and finally sole heir of Sir John Clifford, of Frampton, co. Gloucester. He d. (1315-16), 9 Ed. II. His widow was living (1319-20), 13 Ed. II. II. 1316, 2. Robert (Fitz-Payne), Lord Fitz-Payne, only s. to and h., aged 28 at his father's death. He was sum. to Pari, as a 135 t. Baron from 7 Aug. (1327), 1 Ed. III., to 15 Nov. (1351), 25 Ed. III. He served in the wars in Scotland and France and was a Knight Banneret before 1311. He m. before (1323-24), 17 Ed. II., Ela, widow of John MaRKSCHAL, of co. Norfolk, being probably a sister of Guy, Lord Bryan, and a da. of Sir Guy de Bryan. He d. s.p.m. (1354), 28 Ed. III., when the Barony becamo dormantl") till in 1450 it fell into abeyance. His widow d. (1356), 30 Ed. III. Hobert de Guey, jt. s. of Kicliaid, Lord Grey de Codnor, by Johanna, his wife, having m. before (1323-24), 17 Ed. II., Elizabeth, sister of Guy, Lord Bryan, and probably sister of Ela, Lady Fitz-Payne abovenamed, inherited, on the death of the said Ela, most of the estates held by her and her husband, Lord Fitz Payne aboveuamed. under a settlement made by them in (1323-24), 17 Ed. II., to that effect, in the event of their dying without male issue. He was accordingly in (1356), 30 Ed. III., found heir by grant to the said Ela. He thereupon assumed the name of Pilz Payne and is sometimes (tho' erroneously) supposed to have been a: LORD-FITZ PAYNE 0 April 1369. ( c ) He d. s.p.m. (1392-93), 16 Hie. Isabel (30 years old at her father's death in 1354) would appear to be de jure suo jure Baroness Fitz-Payne, but neither she nor her heirs ever assumed that dignity. She m. John Chideocke (who d. 1387) and had a s. and h., Sir John Chideocke (aged 40 in 1387) whose s. and h. Sir John Chideocke (aged 15 in 1416) left at his death in 1150 two daughters and coheirs among whose descendants this Barony still remains in abeyance. Of these daughters (1) Katharine m. (secondly) Sir John Arundel, of Lanherne, and is represented by the heirs of Sir John A., of Lanherne, who d. s.p.m. in 1701 ; while (2) Margaret m. William (Stourton), Lord Stourton, and is represented by Lord Mowbray, Segrave, and Stourton, who is thus (1890) coheir (i.e., the heir to a moiety) of the Barony of Fitz Payne. (°) " He is said to have been sum. to Pari., in Dugdale's List of Summonses, 6 Apr. (43 Edw. III.), 1369 : but it appears, from a MS. note of the late Francis Townsend, Esq., Wiudsor Herald, and which the List of Summonses printed by order of the House of Lords confirms, that the names of the four Barons last mentioned in that writ, as given by Dugdale, viz., Johanni filio Hicardi Grey de Codenoure, Johanni de Tibetot, Moberto Pitz-Vaine, and Henrico de Percy, are not on the roll." Richard, Lord Poynings, and from the heiress of Robert, Baron Poynings (s. and h. of the said Richard, Lord Poynings, and Isabel Fitz-Payne, his wife), marrying Henry Percy, s. and h. apparent of Henry XIII., 2d Earl of Northumberland (who was sum. to Pari jure uxoris as Baron Poynings) his descendants styled themselves Barons Poynings, Fitz-Payne, and Bryan. Under the latter title it has been clearly proved [vol. ii, p. 45, note "a"] that the Earls of Northumberland had no claim to the Barony of Bryan ; and, with respect to the Barony of Fitz-Payne, it is evident that, as Isabel de Grey, alias Poynings, da. and h. of the above Robert de Grey, did not descend from Robert Fitz-Payne, who was sum. to Pari, in 27 Edw. I., she could not have possessed any right to the Barony created by that writ ; and as it appears that her father was not sum. to Pari, (or at least that there iB no record of it on the roll) the said Isabel could never have inherited any Barony whatever."
