Contains 28 Seif. 1editAn infant from the idolaters who does not utter idolatry, if he touches it he does not prohibit the wine by touching it but only by drinking it. 2editA ger toshav, meaning someone who accepted on himself the seven mitzvot, and also a convert who has been circumcised but not immersed, their touch prohibits its drinking. Rema: And as long as he has not immersed properly he is called not immersed (Ran P. haSokher and Hagahot Mordekhai of Yebamot P. haCholetz). But some are lenient even with the touch of a ger toshav (Tur in the name of the Rosh, Tosafor, and Mordekhai), but his wine is definitely forbidden (B"Y). 3editOne who purchases slaves from idolaters, and circumcises and immerses them immediately, their wine is not poured out, and wine touched by them is permissible for drinking, even though it is not yet customary among the Jewish religion, and they have not renounced idolatry verbally. 4editThe children of non-Jewish maidservants born within Jewish territory, who have been circumcised but not yet immersed, adults prohibit their wine for drinking upon contact, but the contact of minors is permissible even for drinking, as long as they have been circumcised, even though they have not yet immersed. 5editIf the maidservant immerses for the purpose of servitude, there are those who say that her child does not make wine idolatrous, even if his teacher transgressed and did not circumcise him, whether he is an adult or a minor. 6editEvery idolater who does not worship idols, his wine is forbidden for drinking and permitted for benefit, and the contact of our wine is equivalent to theirs, which is forbidden for drinking. 7editThere are those who say that wherever they said our wine, which is permitted for benefit and forbidden for drinking due to the side contact of an idolater who worshipped idols, but if the prohibition was due to the idolater who does not worship idols who touched our wine unintentionally or splashed on the rim of the barrel, it is permissible for drinking, and likewise in all similar cases. 8editOne who was circumcised but not yet circumcised does not render wine idolatrous, and a heretic, even though he was circumcised, makes wine idolatrous through his contact, and he is trusted to say that he has repented. 9editEven those who are compelled, even the righteous among them, cannot be cautious about the contact of idolaters, and since they are suspected of it, they are not trusted regarding their own [wine], even with an oath. However, they are trusted regarding others'. Rema: And they do not forbid wine by their contact specifically; rather, only those who are still openly among the idolaters and commit transgressions publicly because of coercion. However, they are cautious in private, and they can save themselves, but they delay because of money or similar reasons. But if they transgress even in private regarding transgressions, even though they were initially coerced, they are considered like idolaters. 10editContact by an idolater to prohibit wine for benefit requires three conditions: First, he intended to touch [the wine] to divert a baby who touched it, as it is not intentional contact. Second, to divert something fallen into a pit, or remove a carcass. Third, that he will not engage in anything else. 11editHow is the contact that prohibits an idolater's wine for benefit? If he touched it with his hand or foot (and some say that if he touched it with his foot, it does not prohibit for benefit because there is no usual pouring with it), or with another object in his hand, and he licked it, even just from his mouth, such as drinking from it, or sucking on a nipple in a barrel, and brought it to his mouth, all the wine is prohibited for benefit in any case. A vessel that has a spout, like vessels taken with hands and containing wine, an Israelite can suck from this spouted vessel, and an idolater from this spouted vessel, as one, provided that the Israelite drinks first before the idolater. Rema: (If he touched it with the steam above the wine, it is as if he touched the wine itself) (Mordechai, chapter after Avodat Kochavim, and Beit Yosef according to the opinion of Rif and Rambam)* 12editAn idolater who enters the house or shop of an Israelite to request wine, and extends his hand while searching, and touches the wine, and when they spill it, it is prohibited for benefit. And if it mixes with another's wine, the mixed wine is prohibited for benefit. But the rest is permissible for benefit. However, if he extends his hand to a barrel, thinking it is for oil and finds it to be wine, it is permissible for benefit. 13editIf one extends his hand to a barrel of wine to take something that fell inside, and his hand grasped it before he withdrew it, and he did not shake it, and he opened the barrel from below until the wine flowed out, and it dripped below his hand, it is permissible for benefit. 14editA barrel from which the faucet was removed and an idolater inserted his finger into it until he touched all the wine is prohibited. Similarly, if he removed the plugged faucet with a hole and it was touching [the wine] until the point where it is impossible not to shake [the wine]. Rema: Specifically when he knew that the faucet passes through all the strainers. But if he did not know, it is considered the contact of an idolater unintentionally through another object, and it is permissible even for drinking. And the same applies to what remains in the barrel, which is permissible even for drinking, and what comes out is prohibited for drinking. Rema: And if it came out unintentionally, even what came out outside is permissible, for the contact of an idolater unintentionally is permissible. Refer to later in Clause 125 if there was a long faucet inside the barrel and inside that faucet there was a hole, and they put a small faucet in it to plug its hole. If only the small faucet was removed and it does not pass through all the strainers, it is sufficient. 15editAn idolater fool who enters a house with wine barrels, and an Israelite enters after him and finds the wine flowing from the hole where the faucet was inserted, it is permissible even for drinking. 16editIf an idolater shook the faucet and did not take it out of the wine, and the faucet was long and its side passed through and entered the wine, if the faucet is not tightly closed, the wine is prohibited due to this shaking. But if it was tightly closed, it is permissible. 17editSome say that if an idolater holds an open vessel of wine and shakes it, even without lifting it and without touching the wine, it is prohibited. Rema: Many argue that if he shook it with the body of the vessel without lifting it, it does not constitute shaking (Rashba, Rabbeinu Asher, Raavad, and the Rash in the name of most authorities). Therefore, there is no need to be stringent in a case of potential loss. 18editIf an idolater takes a vessel of wine, lifts it, and pours the wine, even without shaking it, it is prohibited because the wine comes from his effort in lifting it, not from shaking or touching, so it is permitted. Rema: Even more so, he does not prohibit the touching of the vessel alone (according to the opinions of the aforementioned authorities and the Ri'vash, Clause 317). 19editIf an idolater measured a pit containing wine with a reed, or if he was covering the boiling barrels with their lids so the boiling would subside, or if he took a barrel and poured its contents into the pit, he is allowed to benefit from it but not to drink from it. Rema: In all these cases, there is evidence that he intended only for his work, and it is contact of an idolater unintentionally, which only prohibits drinking. Some say that even if he measured with his hand, it only prohibits benefit (Tosafot, Ri'vash, Tur, Ra'avad, and Rabbi Yerucham), since he is occupied with his work, and one should be lenient in a place of potential loss. If an idolater's way is to preserve the wine, and it is seen that he did not touch it, the wine is only prohibited for drinking since he was also occupied with his work (Tur). Refer above to Clause 123. Similarly, if he put his hand into a barrel without knowing there was wine inside, he is not prohibited from benefiting (Tur, citing Ra'avad, Rash, and Rabbi Yerucham). It is not comparable to the previous cases, and there is nothing in it except what the Sages said (Tur, Rash, Ra'avad, and Rashba). 20editAn idolater who fell into a pit of wine and was lifted out of it dead is permissible for benefit and prohibited for drinking. But if he emerged alive, he is prohibited for benefit. Rema: The same applies if he stumbled and rolled inside the wine and also rolled outside due to his incapacity (Beit Yosef, citing Rashba). 21editIf an Israelite fell into a pit of wine, and an idolater extended his hand, grabbed him, and pulled him out, and another Israelite was there who watched to ensure that he did not touch the wine, it is permissible even for drinking. Rema: It does not constitute direct contact if touched by a person (Ri'vash, Clause 317). 22editA barrel that cracked lengthwise, and an idolater hugged it to prevent the shards from spreading, is permissible for benefit. But if it cracked widthwise, and he put his hand on it and pressed until it tightened and prevented the wine from flowing out, it is permissible for drinking because it does not constitute touching, and the barrel is squeezing the wine itself, merely an action to stabilize it, just like a clasp on a barrel. And in a wooden barrel with hoops, even if it cracked lengthwise and an idolater hugged it, it is permitted for drinking (Ran, citing Tosafot, and this is our tradition, and in the gloss of Maharik citing Rashbam and Mordechai citing Rashi). 23editIf a barrel had a hole in its side, and the stopper fell out of the hole, and the idolater placed his hand over the hole to prevent the wine from pouring out, thus saving all the wine from the top of the barrel to the hole, it is prohibited for benefit. But the wine from the hole and below is permissible for benefit and prohibited for drinking. Rema: The entire contents may be sold, except for the price of the prohibited wine (Beit Yosef, citing Ra'ah). This applies only when there was an Israelite present to save the wine, and an idolater came and saved it. But if there was no Israelite present to save it, and an idolater came to save it, it does not detract from his action of measuring with his hand since he is occupied with his work, and all is permissible for benefit (Beit Yosef, citing Rashba and Ra'avad). All this only applies when he placed his hand on the hole or placed a spigot there and did not pierce through the entire thickness of the barrel. But if he inserted his finger inside or a long spigot, it has already been clarified that all is prohibited for benefit (the same sources and Tur, citing Mordechai, and others). 24editIf it involves a situation where, if the idolater did not place his hand over the hole, all the wine would pour out, such as when they make a bent straw where the head is placed into the wine inside the barrel while one end is outside the barrel, and they suck the wine, thus causing all the wine in the barrel to pour out, if the idolater placed his finger on the straw and prevented the wine from flowing, all the wine in the barrel is prohibited for benefit because it would all pour out due to his action, and if the idolater did not touch the wine but only the wine froth standing in the jar, it is prohibited due to being poured out. But all the other wine inside the pitcher is poured out by a secondary pouring and is permissible even for drinking. 25editContact of wine by an idolater through something else unintentionally, such as when he was descending from a palm tree and had a lulav in his hand and touched the wine unintentionally, or when he was walking and unintentionally touched the edge of his garment to the wine, or similarly, if he intended to touch it with something else but did not know it was wine, it is permissible even for drinking.
26editIf a flask containing wine was floating, and an idolater touched it from outside, even if it is deficient, and its corners met, it is permissible, even for drinking, since this is not the usual way of pouring. 27editA spigot that was loose in a barrel, and an idolater tightened it, is permissible even for drinking. 28editA wooden barrel that drips or leaks may be taken by an Israelite youth, who will hold it against the hole to prevent some wine from pouring out, and then an expert idolater may come and seal it with a knife in the hole, as long as the wine does not pour out too much. If the wine poured out a lot, one must be more cautious so that the idolater does not touch the wine. However, after the fact, even if he did touch it with a knife, it is permissible (Tur and other authorities). If one desires to do what is more preferable, he should seal the barrel with a rope and stop the flow of wine, and then repair it afterward. |

מגע עובד כוכבים לאסור בהנאה צריך שלשה תנאים אחד שיתכוין ליגע לאפוקי תינוק שנגע דלאו בר כוונה הוא וכן לאפוקי נפל לבור ועלה מת שני שידע שהוא יין ושלישי שלא יהא עוסק בדבר אחר: כיצד היא הנגיעה שאוסר בה העובד כוכבים היין בהנאה שיגע בידו או ברגלו (וי"א דאם נגע ברגלו אינו אוסר בהנאה דאין דרך נסוך בכך) (בב"י) או בדבר אחר (שבידו) וישכשך אפילו בפיו כגון ששתה ממנו או שמצץ במניקת בחבית והעלהו לפיו כל היין אסור בהנאה מכל מקום כלי שיש לו חוטמין כמו שיש לכלי שנוטלים ממנו לידים ויש בו יין יכול ישראל למצוץ מחוטם זה ועובד כוכבים מחוטם זה כאחד ובלבד שיפסוק הישראל קודם שיפסוק העובד כוכבים.
עובד כוכבים שנכנס לבית או לחנות ישראל לבקש יין ופשט ידו כשהוא מחפש ונגע ביין ושכשכו נאסר בהנאה ואם נתערב באחר דמי היין המשוכשך אסור בהנאה והשאר מותר בהנאה אבל אם הושיט ידו לחבית כסבור שהוא של שמן ונמצאת של יין מותר בהנאה: הרי שפשט ידו לחבית של יין : (ליטול משם דבר שנפל שם) (תוספות ורא"ש ור"ן וטור) ותפסו ידו קודם שיוציאה ולא ינידה ופתחו החבית מלמטה עד שיצא היין וירד למטה מידו מותר בהנאה: חבית שנטלה ממנו הברזא והכניס בה עובד כוכבים אצבעו עד שנגע ביין כולו אסור וכן אם הוציא הברזא התחובה בנקב והיתה נוגעת עד היין שא"א שלא שכשך:
אבל אם אינה עוברת כל עובי השוליים בעניין שאי אפשר לו לשכשך כשמוציא הוי כמו כחו ומה שנשאר בחבית מותר אפילו בשתיה ומה שיצא אסור בשתיה.
עובד כוכבים שוטה שנכנס לבית שיש בו חביות של יין ונכנס ישראל אחריו ומצא היין יוצא דרך הנקב שהברזא תחובה בו מותר אפילו בשתייה: אם נדנד עובד כוכבים הברזא ולא יצא מן היין לחוץ והברזא ארוכה ועברה הדופן ונכנסה בתוך היין אם הברזא אינה מהודקת בחזקה נאסר היין בנדנוד זה אבל אם היתה מהודקת בחזקה מותר: יש מי שאומר שאם אחז עובד כוכבים בכלי פתוח של יין ושכשכו אע"פ שלא הגביה ולא נגע ביין נאסר:
נטל עובד כוכבים כלי של יין והגביהו ויצק היין אע"פ שלא שכשך נאסר שהרי בא היין מכחו הגביה ולא שכשך ולא נגע מותר:
מדד עובד כוכבים הבור שיש בו יין בקנה או שהיה מטפח על פי החביות הרותח' כדי שתנוח הרתיחה או שנטל חבית וזרקה בחמתו לבור מותר בהנאה ואסור בשתיה:
עובד כוכבים שנפל לבור של יין והעלהו משם מת מותר בהנאה ואסור בשתיה אבל עלה חי אסור בהנאה:
ישראל שנפל לבור של יין ושלח עובד כוכבים ידו ואחז בו והוציאו וישראל אחר היה שם ששמר שלא נגע ביין מותר אפילו בשתייה:
חבית שנסדקה לארכה וקדם עובד כוכבים וחבקה כדי שלא יתפרדו החרסים הרי זה מותר בהנאה אבל אם נסדקה לרחבה ונתן ידו עליה והכביד עליה עד שהדקה ומנע יציאת היין מותר בשתיה משום דלא הוי נוגע ודוחק יין החבית אלא מעשה לבינה בעלמא קא עביד שהרי היא כלבינה הנתונה על פי החבית ומכבידתה ובחבית של עץ שיש להם חשוקים צירקא"ליש בלע"ז גם כשנסדקה לארכה וחבקה עובד כוכבים מותרת בשתייה: (ר"ן בשם תוספות והוא בתו' שלנו ובהגהת מיי' בשם רשב"ם ומרדכי בשם רש"י): חבית שהיה נקב בצדה ונשמט הפקק מהנקב והניח העובד כוכבים ידו במקום הנקב כדי שלא יצא היין כל היין שמראש החבית עד הנקב אסור בהנאה ושמן הנקב ולמטה מותר בהנאה ואסור בשתייה:
ואם הוא בענין שאילו לא הניח העובד כוכבים ידו על הנקב היה יוצא כל היין כגון שעושין מינקת כפופה שמניח ראשה לתוך היין שבחבית והראש האחד חוץ לחבית ומוצץ היין ועל ידי כן יוצא כל היין שבחבית אם הניח העובד כוכבים אצבעו על פי המינקת ומנע היין מלירד נאסר כל היין שבחבית בהנאה שהכל היה יוצא ונגרר לולי ידו ונמצא הכל כבא מכחו ואם לא נגע עובד כוכבים אלא בקילוח היין שעומד במרזב אסור משום נצוק וכל היין האחר שבתוך הקנקן הוי נצוק בר ניצוק ומותר אף בשתייה: מגע עובד כוכבים ביין ע"י דבר אחר שלא בכוונה כגון שהיה יורד מהדקל ובידו לולב ונגע בראש הלולב ביין שלא בכוונה או שהיה מהלך ונגע בכנף בגדו שלא בכוונה וכן אם נתכוין ליגע בו ע"י דבר אחר אלא שאינו יודע שהוא יין מותר אפילו בשתייה:
נוד שיש בו יין ונגע עובד כוכבי' בנוד מבחוץ אפילו הוא חסר והגיעו דפנות זו עם זו מותר אפילו בשתייה שאין דרך ניסוך בכך: ברזא שהיתה רפויה בחבית ובא עובד כוכבים והדקה מותר אפי' בשתייה: חבית של עץ שהוא מטפטף או שותת יקח ישראל הנעורת בידו ויניחנה כנגד הנקב שימנע היין קצת מלצאת ויבא עובד כוכבים אומן ויהדקנה בסכין בנקב עד שיסתום היטב ואם היין שותת הרבה צריך ליזהר ביותר שלא יגע העובד כוכבים ביין (בידו אבל בסכין בדיעבד שרי) (טור והפוסקים) והרוצה לעשות מן המובחר יהדק החבית בחבל ויפסוק שתיתת היין ואחר כך יתקננו:
